    Judith Scurlock widow of Thomas Scurlock dec'd, JOHN THOMPSON and REBECAH his wife, Charles Mason and Anne his wife, William Tune and Rainey his wife, and Zachariah Williams guardian of Betsey, Beverly, Sally, Joshua & Washington Scurlock orphans of the said Thomas Scurlock Dec'd...Plaintiffs - In Chancery
    against Dudley Scurlock & John Hill and Judith his wife......defendants

    Zachariah Williams is appointed Guardian of Betsey, Beverly, Sally, Joshua and Washington Scurlock orphans of Thomas Scurlock deceased for the special purpose of presenting their suit. By consent of the parties the case came on to be heard upon the bill and answer, and the agreement of counsel - On consideration whereof it is ordered and decreed that Charles Thompson, Charles Womack, William W. Womack, Thomas Dixon and Isaac Farguson or any three of them who are appointed commissioners for that purpose, do lay off, allot and ___ unto the plaintiff Judith Scurlock her equal third part of and in two hundred fifty four acres of land, whereof the said Thomas her late husband did siezed in the bill mentioned, to hold as her dower therein and also ___ to her one equal third part of the personal estate of the said decendant - that they then sell to the highest bidder on a credit of twelve months the said two hundred and fifty four acres of land, subject to the life estate of of the said Judith in the dower aforesaid - the purchaser to give bond with good security, and that they convey to the purchaser the fee(?) simple estate therein - And that the money arising from the sale of the said land, together with the personal estate of the said intestate that shall remain after allotting to the plaintiff Judith one third part thereof, be equally divided among all the children of the said Thomas Scurlock deceased, except Dudley Scurlock, who hath received his proportion by way of advancement, in the lifetime of the said decedant. And that they make report thereof to Court, in order to a final decree."

    "To the worshipful Court of Halifax County in Chancery setting - Humbly complaining shew unto your worships your orators and oratrices Charles Mason and Anna his wife, late Anna Scurlock, JOHN THOMPSON & REBECCA his wife, late Rebecca Scurlock, Judith Hill, late Judith Scurlock widow & relict of John Hill deceased, Amos Hill & Betsy his wife, late Betsy Scurlock, Samuel Wood & Sally his wife, late Sally Scurlock & Beverly Scurlock, which said Rebecca, Judith, Betsy, Sally & Beverly are children of Thomas Scurlock deceased & Judith Scurlock his wife.

    That Thomas Scurlock late of this county departed this life some 20 years ago intestate & John Hill who has since deceased, administered on said Thomas, bought of the estate of the said Thomas a negro Simon who was legally sold by the administrator as of his own property. That some years thereafter Washington Scurlock another of the children of the said Thomas with the consent & approbation of the old lady sold said negro Simon to William Tune who intermarried with Raney Scurlock another of the children of said Thomas at the price of $425 and the old woman made the Bill of sale in her own name. That the said William Tune has never paid for said negro and the said Washington Scurlock claims the proceeds of said sale alledging a will made by this old lady bequeathing the negro to him. Your orators & oratrices say she never made such will & that that she died intestate and therefore that the proceeds of the sale of said negro must be distributed between the ...?.... & the said Washington Scurlock & William Tune, but the said Washington Scurlock & William Tune will not consent to the distribution. In tender consideration whereof & inasmuch as your orators and oratrices are same ...?... in the premises of law and only reliable(?) in Equity. To ..?.. and therefore that Washington Scurlock & William Tune & Raney his wife made defendants to this Bill & complaint to answer the same fully & .......?........ on ....?.... corporal ......?..... That the court may decree a distribution of the proceeds of the sale of said negro, that William Tune be compelled to pay the amount of the purchase money except only his proportionable share & finally grant..............."

    "To JOHN THOMPSON - You will please to take notice that on the eleventh day of this present month at Daniel Nunnelee's tavern in the County of Halifax, between the rising and setting of the sun on that day, I shall proceed to take the depositions of William Hall and others, to be read on evidence in a suit now depending in the county court of Halifax in which you and other are plaintiffs and I am defendant, at which time and place you may attend if you will."
