    To the worshipful Court of Halifax County in Chancery setting humbly complaining thereunto your worships your Orators and Oratrices Meredith Conally and Sally his wife, Polley Tune, Joshua Tune, Thomas Tune, William S. Tune, Kester T. Tune, Judith Tune, Jonathan Tune, Willie Tune, David Tune and Elizabeth Tune; which said Thomas, William S. Kester T. Judith, Jonathan, Willie, David & Elizabeth are infants and sue by their next friend the said Meredith Conally: that William Tune late of the County of Halifax aforesaid has departed this life intestate, seised of a tract or parcel of land containing about two hundred acres, some slaves and other personal estate: That your Orators and Oratrices and a certain Demarcus Tune are the children, heirs and distributees of the said decedent, who left also a widow Lurana Tune surviving him.

    I, D. M. Tune, being of sound mind and memory do this day make this my last will and Testament in view of my demise..

    1st I commend my Soul to God who gave it and my body to the earth whence I came..

    2nd I will that all my Debts and funeral expenses be paid out of the means in my possession

    3rd I will that all my personal and real estate be paid out of the means in my possession

    4th I will that all my personal and real estate be sold with the exception of a sufficient amount of my personal property as may be deemed sufficient for the protection of my beloved Wife Elizabeth Tune

    5th I Will and bequeath to my beloved wife Elizabeth Tune two thirds of my estate to be appropriated to her benefit as may be considered best and one third to my Daughter Sarah

    6th I choose John H. Holt Executor and Elizabeth Tune Executrix of this my last will and Testament and that they take charge of all my effects immediately after my Death.

    Abstract of the will of D.M. TUNE, Franklin County, Tennessee

    He made his will in Franklin County on 10 Jan. 1860. He named his wife Elizabeth and his dau. Sarah. John H. HOLT was his executor. Witnesses were Lavan JONES and William B. HOLT. The will was probated at the May, 1860 term of court. Will Book I, page 396.
    John H. and William B. HOLT were sons of Jacob HOLT and sons-in-law of Dennis B. MUSE. These families were all living in the same area.This makes Elizabeth only 12 years the junior of D.M.
