    Sunday, the thirty first: Recieived into the choir: Adam Dell, Jac. Uhrich, Jac. Romig, Gustaph Fuchs, Theodore Fuchs, John Keiser, Benjamin Walton, Hiram Walton, Friederich Blickensderfer.

    John Kiser's will (A2434 Docket #5, p. 81) mentions wife Catharine and unnamed children. Witness to the will was his brother, Martin Kiser.

    The will reads as follows:

    Will of John Kiser

    I John Kiser of the County of Tuscarawas and State of Ohio do make and publish this my last will and testament in manner and form following, that is to say

    First it is my wish that my funeral expenses and all my ______ debts be fully paid

    Second I give devise and bequeth to my beloved wife Catharine Kiser the plantion [sic] on which we now reside containing about forty six and a half acres and all the personal property of every kind that I may own at the time of my decease, as long as she remains my widow. She having the privilege to sell so mutch [sic] of the personal property that may be necessary to pay debts and taxes and for her support from time to time, as she may if to spare, and at the death of my said wife all the property hereby devised or bequethed to her as aforesaid on so mutch [sic] thereof as may then remain unexpended I give to my children that I had by my wife Catharine Kiser equally share and share alike

    and lastly I hereby constitute and approach my said wife Catharine Kiser to be the Exector of this my last will and testament and it is my wish that she shall not give bond nor make any any [sic] appraisment of any properties after my decease. Revoking and annulling the former wills by me made and ______ing and _______ing this and no other to be my last will and testament.

    Tuscarawas County} We John Judes and Martin Kiser being duly sworn in ___ Court this 17th day of February AD 1870 ______ and say that we were present at the execution of the last will and testament of John Kiser (now deceased) hereunto annexed; and that we saw the said testator subscribe said will and heard him publish and declare the same to be his last will and testament; and that the said testator at the time of executing the same was of full age and of sound mind and memory and not under any restraint; and that we signed the same as witnesses at his request and in his presence and in the presence of each other.

    Be it remembered that in the Probate Court of the County of Tuscarawas and State of Ohio on this day the 14th day of February in the year of our Lord One Thousand Eight Hundred and Seventy at the town of New Philadelphia within said County, before W. B. Brown Judge of said Court amond the proceedings there and there had were the following viz:

    John Kiser } The last will and testament of John Kiser deceased late of the county of Tuscarawas and State of Ohio was this day provided in Court and _________ came John Judy and Martin Kiser the subscribing witnesses to said will and in _____ _____ on affirmation testistified to the ___ __________ and attestation of said will, which testimony was reduced to writing and by ___ ______ively subscribed and filed with said will, and if appearing to the Court by said testimony that said will was duly executed and affected and that the said testator at the time of executing the same was of full age and sound mind and memory and not under any restratint: It is ordered by the Court that said will be and the same is hereby admitted to probate and together with teh testimony ordered to be recorded.

    And thereupon came Catharine Kiser the Executrix in said will named and in _______ signified her acceptance of the trust of executing said will, It is therefore ordered by this Court that letters tesamentary be granted and issued to the said Catharine Kiser, and it appearing to the Court that the said testator by the terms of his said last will and testament has expressed a wish that said executrix may execute the same without giving bond, it is further ordered by the Court that a bond in this case be not requirred. And it appearing by the terms of said will that said testator has also expressed a wish that there shall be no appraisment of his presonal property it is further ordered by the Court that the same be omitted, And thereupon came Catharine Kiser widow of [There seems to be more, yet the next page is as follows:]

    Compiler's notes/theories:

    There is a Jacob Keiser who was born 9 Dec 1836 and served in Co. B, 51st OVI from January 1, 1864 to October 3, 1865. This Jacob was a native of Switzerland (perhaps a cousin to mine????) and was naturalized in Tuscarawas County. The final record of his naturalization was dated November 25, 1865 and says that he had resided in the US for at least 5 years and that he had resided in Ohio at least one year. He is listed in the Fair Avenue Cemetery in New Philadelphia, Tuscarwas County, Ohio. There is no death date listed (only his birth and Civil War Unit). (10/2000: Sharon Leichty has more info on this line, though he is not connected to hers either)

    This may the same Jacob Kiser who died of consumption at age 42 on April 24, 1876 (though that age would make him born in 1834 instead of 1836, but the informant could have been wrong). The death record says he was born in Switzerland and lived in Goshen Twp of Tuscarawas County. It also said he was married, but gives no name for the wife.

      1896

      Mrs. Catherine Keiser (da. of Jacob Swalley). Born near Hagerstown, Carrol [sic] Co. Ohio Feb. 15th 1815. Baptized in infancy, confirmed in New Philadelphia in Lutheran Denomination. Married to John Keiser at about 20 years of age and resided there in Fry's Valley to the time of her death. The mother of 6 sons and 5 daughters. 2 sons and 4 daughters preceded her to their graves. Her husband died Feb. 8th 1870. She died at about 4 o'clock on Wednesday afternoon April 24th 1896 of general failing and ___several unreadable words__ and inability to take nourishment. Her age was 81 yrs 2 mos & 14 days.

      The funeral services were held in the Moravian Church at Gnadenhutten and interment was in the Gnadenhutten Cemetery. The funeral was conducted by the Fry's Valley Cemetery and Bishop Van Vleck assisted __couple unreadable words__. H. J. Hartmann
