    Nota Bene: The eleven children shown on this census report do not correspond to the five identified children of Ezekiel Daniel, Sr., that were born before 1820. Also, there is a suspiciously long 10-year period between the 1806 birth date of Ezekiel, Jr., and the 1816 birth date of daughter Sophia, which suggests that there might have been up to six additional children who died before the 1820 census was taken.

    Ezekiel was granted land, being Lot #18, of Section Three, in Township Eight, north, of Range Sixteen East, in the District of Lands subject to sale at Columbus, Mississippi, containing forth acres, and five hundredths of an acre. [The 40.5 acres were located in Choctaw, Lauderdale County, Mississippi.]

    The grant was signed for James K. Polk, President of the United States and was dated the first day of September, 1848, by J. K. Stephens, Asst. Sec'y., and was recorded by S. H. Laughlin, Recorder of the General Land Office.

  • Will: 24 Apr 1858 Lauderdale County, Mississippi
  • Note:
    Ezekiel Daniel made a will in Lauderdale County, Mississippi, dated 24 April 1858 and it was proved there in the July 1858 term (Record of Wills 1, pages 6-9, 11-12). The will named a current wife and fifteen children, including seven sons (two deceased) and eight daughters. His wife's name was written as "Levinia" in the will and as "Lavina" in the probate record.

    The will provided for Levinia and her two minor sons: William Crosly or Crosby Daniel and Julius Calvin Daniel. To them he left about 400 acres in Lauderdale County, described as lots 4, 5, 6, 7, 10, 11, 15, 16, and 18 of Section Three, and lots 13 and 20 of Section Two, Township 8, Range 16 East. He left them also ten slaves, 4 horses or mules, 6 cows and calves, 4 sows and pigs, 2 yoke of oxen, 15 year-old hogs and a year's provisions, one road wagon, one buggy, and all kitchen and household furniture excluding two bedsteads. To each of his eight daughters, all of whom were married, he left one slave. Daughters were Frances (Fullilove), Sophia (Ward), Elizabeth (Perry), Siphronia (Davis), Emily (Crockett), Temperence(Crockett), Martha (Garrett), and Polly Ann (Turner).

    A full inventory was found in Inventories and Appraisals, Volume 1 (1858--1864), pages 66 ff. The net worth of his estate, excluding real estate, was set at $22,803.74.

    Ezekiel bequeathed $50 to the heirs of Thomas Daniel and the same to the heirs of Ezekiel Daniel [Jr.]. Judge M. and Augustus T. each received a bed and bedstead. Augustus T. and Lumpkin J. each received two slaves and together with Judge M. inherited the remainder of the land not distributed to Levinia and her sons. To Lumpkin J. and Judge M. went blacksmith tools for use on the land.

    The will was witnessed by John N. Rhodes, Shelton J. Brown, and P. H. Partin. As executors, Ezekiel named John Tennin and/or William Parker. For whatever reason it was decided that Lumpkin J. Garrett [son-in-law and brother of Ezekiel's second wife, Nancy (Garrett) Bishop] would administer. Lumpkin J. Garrett, William C. Rush, and Thomas C. Bishop (all of Kemper County, adjoining Lauderdale on the north), and John Tennin of Lauderdale County jointly posted an administration bond for $25,000 on September 20, 1858.

    In October 1858, Garrett filed a petition to sell cotton at Mobile as well as other property. Probate minutes at that time mention citations to -- Judge M. Daniel, Lavinia Daniel, Saphrona A. Ward, Frances and Willis Fullilove, and minors W. C. Daniel and Julius Daniel, all of Lauderdale County; -- L. J. Daniel and M. A. Garrett of Kemper County; -- Emmy and M. S. Crocket of Smith County; -- Mary A. and S. S. Turner of Jasper County.

    A notice was run in the Lauderdale Republican for four weeks to reach the following: -- Siphronia Davis and husband; Elizabeth and Jack Perry; Tempy and David A. Crocket; A. T. Daniel; and heirs of Thomas Daniel.

    -- Additional citations dated November 1858 were to Elizabeth, Amanda M., Egbert B., Mary T., Elizabeth A., and Susan C. Daniel, all of Lauderdale County; -- James A. Daniel of Noxubee County; -- Mahala H. and William L. Richardson of Winston County; -- Keziah A. and James Manasco and Augustus A. Daniel of Clarke County.

  • Note:
    A letter filed with papers relating to an Ezekiel Daniel of South Carolina who received a pension based on Revolutionary War service was written on October 4, 1937 by Alicia (Osborne) Mote of Columbus, Georgia. She was seeking information about a great-great grandfather named Ezekiel Daniel of Morgan County, Georgia, whose daughter Temperance had supposedly married David Crockett, Junior, son of Davy Crockett of Alamo fame.

    Mrs Mote was correct that her great-great-grandfather was named Ezekiel Daniel and that her lineage was through Ezekiel's daughter Temperance Daniel who married David Archibald Crockett; thence Margaret Elizabeth Crockett who married Alexander S. Harris; thence Sarah S. Harris who married James M. Osborne. It is also true that Temperance Daniel and her sister Emily Daniel married Crocketts. However, she was wrong in believing that Ezekiel Daniel the soldier and Ezekiel Daniel her ancestor were the same person, or that Temperance Daniel married "Davy" Crockett's son. The Crockett husbands were remote kin, if any kin at all, to the legendary "Davy" Crockett.

    Charles Heinemann's Daniel Families of the Southern States (1934) mistakenly identified the SC Revolutionary War veteran as the father of Temperance Daniel. This was three years before Mrs. Mote wrote her letter. Whether they made the error independently or had communicated is unknown. A copy of this compilation of Daniel material is at the Library of Congress in DC.

    An old Crockett history, The Crockett Family and Connecting Lines by Janie Preston Collup French and Zella Armstrong (authors' copyright 1928, printed Bristol, TN), volume 5 of the Notable Southern Families series, suggests that Temperance Daniel's husband, David Archibald Crockett, and Emily Daniel's husband were nephews of "Davy" Crockett of Alamo fame. That is not correct either.

    In their book they ran together two different Crockett families and put them both under a Wilson Crockett who was the father of neither line. Their book gives 1821 for Temperance Daniel's birth and a date of 1835 for her marriage (which it says was in Greene County, Georgia). (There is, in fact, a Morgan County, Georgia, marriage record for 27 Dec 1835.) It does not name Temperance Daniel's parents. They did not have the record for the other Crockett-Daniel marriage.

    The Crocketts who married Daniels were in all probability sons of Elias Crockett and Martha who came to Georgia from near the NC/SC boundary and who were divorced in Morgan County. Elias was possibly the son of Archibald Crockett who was the son of Robert Crockett who came over in 1720.
