!NOTES: WILL: "I George W. Kennedy of the county of Talladega do make and publish this my last will and testament hereby revoking all others. And first I direct that my body be decently intered in burying ground of the Methodist church of Antioch according to the ceremonies of the "Sons of Temperance." And as to such worldly estate as it hath pleased God to interest me with. I dispose of the same as follows: First, I direct that all my debts and funeral expense is to be paid as soon after my decease as possible out of the first moneys that shall come into the hands of my executors from any portion of my estate. I also direct that my two saddle horses be sold either publickly or privatly on a credit of three months. My bridle, saddle and other rigging to be sold with the horses--I also direct that the whole of my household furniture shall be and remain the absolute property of my wife. I direct further that my wife may or may not at her option, sell a certain part of my farm on the west end of same and designation as the hill field containing about thirteen (13) acres for the purpose of paying a portion of my debts. I also direct that all of my real estate belong to my wife during her widowhood and in the event of her marrying again, then the real estate will be all hold at publike sale. In cash or on a reasonable credit as the distrintees may elect--and the proceeds to be divided between my wife and children share and share alike. But if my wife should not marry again, my lands are to remain hers during her life and at her death to be sold and the money to be equally divided between my children or their heirs or representatives of any of my children who shall have died between the time of my decease and the time of such distribution. If it should be thought best by my wife to sell any other field or portion of my land of equal value than the field afore discribed, I invest my wife with the privelidge of doing with it as full powers to convey titles as I myself had while living, and for the purpose of having these my wishes carried into effect. I do hereby make and ordain my beloved wife my executrix and my friend, G W Penn, executor of this my last will and testament. In witness whereof, I George W. Penn to sign his name to said instrument as his last will and testament and that said Penn did sign the name of said Kennedy to said instrument on the day & date therein mentioned that the said Kennedy acknowledges the said instrument to as & to be his last will and testament and that he was at the time of making such acknowledgement possessed of a sound mind & dispossing memory and that they these dissonants and Anthony S.
