Will(1): I Alexander Steel of West township in the County of Huntingdon and State of Pennsylvania being of sound and disposing mind and memory, do make and publish this as and for my last will and testament, hereby revoking and annulling all and every will and testament by me heretofore made and declaring this and no other to be my last will and testament, as follows to wit; In the first place I order and direct that all my just debts and funeral expenses by fully paid and discharged out of my estate as soon as convenient after my decease by my Executors hereinafter named. In the second place, I give and bequeath unto my son John Steel the sum of five hundred and forty dollars, also all my farming utensils and implements, which I left in his possession when I quit farming. Also my bed, bedstead and bedding and my desk, all the above money and effects willed to him by me to be in full satisfaction for all labor and services performed by him for me after he became of age and before he went into business on his own account. In the second place I give and bequeath unto my daughters Jane and Rebecca Steel each of them the sum of three hundred dollars of my estate to be paid thereout to them, also all personal property and effects whatsoever kind and nature they may be which they purchased and furnished and remaining in my house at my decease I hereby will and allow them to take and appropriate to themselves without any let, hindrance or molestation of my Executors herein after named, or of any of my other children or heirs, all my personal property remaining in my house at my decease, I also bequeath to my daughters Jane and Rebecca to be divided equally between them (except what is hereinbefore disposed of ). I also give and bequeath unto my said daughters Jane and Rebecca. two milch cows, my two (or twin) calves, & one riding horse equally between them - and all the rest and residue of my personal property and effects, not hereinbefore willed or disposed of I direct my executors hereinafter named to sell and dispose of either at public or private sale. And further it is my will and I hereby order and direct, and authorize and empower my executors hereinafter named to make sale at public or private sale of all my real estate situate in West township & County of Huntingdon aforesaid of which I am or may be seized or possessed at the time of my decease, for the highest and best price that can be gotten for the same, five years after my decease or sooner if in the judgement of my executors the same would sell better, than if they would wait till the end of the five years or to convey the same to the purchaser or purchasers thereof in fee simple, and the monies arising from the sale of my personal property and effects and the sale of my said real estate to be applied by my Executors hereinafter named, to the payment and discharge of my just debts and funeral expenses and the pecuniary legacies hereinbefore given and bequeathed; and all the rest and residue of the monies remaining in the hands of my Executors arising out of the sale of my real and personal estate or otherwise I will and bequeath the same to my son John and my daughters, Eliza intermarried with Andrew Allison, Matilda intermarried with John Porter & Nancy intermarried with John Nelson, Margaret intermarried with John Grafius. Jane Steel and Rebecca Steel share and share alike. And further it is my will that the one third of the rents, issues and profits arising from or out of my real estate until the same shall be sold, I devise and bequeath the same to my said daughters, Jane Steel and Rebecca Steel, share and share alike. And lastly I constitute and appoint my son John Steel and Col. John Cresswell of Petersburg, Executors of this my last will and testament. Steel Signed, sealed, published, pronounced and declared by the Testator as and for his last will and testament in presence of us who in his presence and in the presence of each other and at the request of the Testator have hereto subscribed our names as witnesses. James Steel - David W. Waldsmith Before me the Probate of Wills etc. in and for said County personally appeared James Steel and David W. Waldsmith who being duly sworn according to law did depose and say that they were personally present and saw and heard the above and within named Testator Alexander Steel sign, seal, execute, publish, pronounce and declare the above and foregoing instrument of writing as and for his last will and testament, and that they signed their names thereto as witnesses in the presence of each other and in the presence of the said Testator and at his instance and request and that at the time of so doing the said Testator was of sound and disposing mind, memory and understanding to the best of their knowledge and belief. Sworn and Subscribed this 20th April A. D. 1859 Before Henry Glazier register codicil to the Last Will and Testament of Alexander Steel late of West township, decd I, Alexander Steel the Testator in the within will named do hereby make this codicil to my said will, as follows, to wit; In lieu and in the room and stead of John Steel and Col. John Cresswell, the Executors named in my said will, I hereby appoint John Rung and William Stewart (son of James) both of West township in the County of Huntingdon to be my Executors of my said will and hereby give and grant unto them all the powers and authorities granted the said John Steel and Col. John Cresswell conferring upon them the authority as Executors thereof. In testimony Whereof I have hereunto set my hand and seal this eleventh day of August A. D. 1858 Signed, sealed, Published, pronounced and declared by the Testator Alexander Steel as and for a Codicil to this within mentioned will in our presence, who in his presence and in the presence of each other and at the testators request have hereunto subscribed our names in witness. James Steel - J. T. Anderson MEMORANDUM - Letters testamentary in common form were this day granted to John Rung and William Stewart on the estate of Alexander Steel late of West township, deceased. Inventory to be exhibited in one month from this date and a just and true account, calculation and reckoning of their said administration within one year from the date hereof or when thereto legally required.
