Note: From National Archives Record S31729 Johnson County, Indiana Johnson Circuit Court March Term A.D. 1834 On this 18 day of March 1834 personally appeared before the Honorable Johnson Circuit Court now sitting Abner Hanks a resident of said county in the state aforesaid, aged 71 years who being first duly sworn according to law doth on his oath make the following declaration in order to obtain the benefit of the act of Congress of June 7, 1832. That he was drafted into the service of the United States in April of the year 1780, under the command of Captain George Harrison, who is the duly commissioned officer under whom he served whose name is now recollected. That at the time of entering said service he was a resident of Richmond County in the state of Virginia. That from the point of enlistment he marched to Leedstown in said state; and while at said place an express arrived informing of the contemplated attempt of the British to land in the Chesapeake Bay and requesting aid, whereupon a second draft was made, and it was the lot of this applicant to be drafted for said expedition. That from the time when he entered the service as aforesaid until his discharge he was constantly engaged in the service of the United States for a period nat less than three months. That afterwards and immediately subsequent to his return home from that performance of the duties aforesaid, he was again drafted into the service of the United States under the command of George Sisson and other officers name of whose names are now recollected. That in this last term of service he was engaged three months principally in guarding the transportation of provisions, and other necessaries of the armies in that part of the country. That at the end of said term this applicant was regularly discharged; but whether that discharge was written or orally given he cannot recollect. - it being the custom then to discharge militia-men both ways; That he has no documentary or other written evidence of his service; and that the whole period thereof was not less than six months. Herewith he presents the affidavit of Samuel Dunaway a citizen of Kentucky who is cognizant of the services by this applicant performed as aforesaid. He hereby relinquishes every claim whatever to a pension or annuity except the present and declares that his name is not on the pension roll of the agency of any State or territory. And in answer to the interrogatories, here now propounded by the court, the said applicant saith 1. That he is informed and believes he was born in Richmond County in the state of Virginia in the year 1763. 2. That he has no record of his age. 3. That when called into service he was a resident of Richmond County Virginia, afterwards of Henry County Kentucky, & now of Johnson County Indiana. 4. That he was drafted into service. 5. That he recalled the names of none of the regular officers who were with the troops with whom he served. 7. That he was is known to William Irwin a clergyman and Richard Foster both of whom are his neighbors whose affidavits are hereto indexed. Sworn to and subscribed March 18, 1834 in open court. William Irwin a clergyman residing in Johnson County Indiana and Richard Foster residing in the same herby certify that we are acquainted with Abner Hanks who has subscibed and sworn to the foregoing declaration. that we believe him to be 71 years old; that he is reputed and believed in the neighborhood where he resides to have been a soldier of the revolution; and that we concur in that opinion. William Irwin Richard Foster Sworn to and subscibed in open court March 18, 1834 And the said court do hereby declare their opinion after the investigation of the matter and after putting the interrogatories prescibed by the War Department that the above named applicant was a revolutionary soldier and served as he states. And the Court further certify that it appears to them that William Irwin who has signed the preceding certificate is a clergyman resident in Johnson County; and that Richard Foster who has signed the same is a resident of said county and is a credible person and that their statement is entitled to credit. In testimony whereof I have hereunto set my hand and seal of the office the 18th day of March 1834 Sam Herriott _________ Henry County This day Samule Dunaway personally appeared before me one Price (Nuttale?) Justice of the Peace in and for said County and made oath that Abner Hanks now a citizen of Johnson County Indiana served with this Deponent in the State of Virginia as a militiaman of the said State, In the revolutionary war for the term of six months the first tours under Capt George Harrison the second under Capt George Sisson, and this deponent further saith that said Abner Hanks was raised in the same neighborhood with him the said Deponent, to wit, in the County of Richmond and State of Virginia when the affor said service was rendered and further this deponent saith not, even under may hand as a Justice of the Peace in and for said county this 4th November 1833. Nuttale?) before whom the forging deposition was taken aas a Justice of the Peace in and for the County of Henry, duly commissioned and qualified and that full faith and credit is due and ought to be given to all his acts as such - In testimony whereof I have here unto set may hand and affixed the seal of said Court at Newcastle this 6th day of Nov. 1833 and the 42 year of the Commonwealth test.
