!3 Dec 1867: Dr. Tom Brooks bought Willow Grove for $7986.00 from Anne Foster Brooks his sister and her husband Thomas Smith: This indenture made this the 3rd day of December in the year of our Lord one thousand eight hundred and sixty seven between Thomas Smith and Nancy F., his wife, of the one part and Thomas Brooks of the other part, the two former of the County of Mathews and the State of Virginia and the latter of the County of Brazoria and the State of Texas. Witnesseth, that the said Thomas Smith and Nancy F., his wife, for and in consideration of the sum of seven thousand nine hundred and eighty six dollars good and lawful money of the United States, to them in hand paid by the said Thomas Brooks, at or before the sealing and delivery of these presents, the receipt whereof they do hereby acknowledge, and thereof acquaint and forever discharge the said Thomas Brook, his heirs, executors and administrators of these presents. Have granted, bargained, sold, released and confirmed unto the said Thomas Brooks, and unto his heirs and assigns forever a certain lot, piece or parcel of land, situated lying and being in the County of Mathews and containing 446 65/100 acres more or less it being the same land on which the said Thomas Smith now resides bounded as follows Viz. - On the North by the main road. East by the land belonging to the estate of Sands Smith, dec'd, South by Horn Harbor and Seth Foster and West by Washington Brownley and land belonging to the estate of Jesse Hudgins, dec'd. Also a piece or parcel of woods land, situated and lying in the County aforesaid and containing 40 acres, be the same more or less, bounded as follows Viz. - on the North by the land belonging to the estate of Geo. E. Tabb, dec'd East by Sterling Borum, South by John Smith and main road West by lthe land belonging to the said Tabb, together with all estate right, title interest and property claim and demand whatever, of the said Thomas Smith and Nancy F., his wife. Also all of the personal estate consisting of household and kitchen furniture, farming utensils, crop of corn and fodder for the present year. 1 Buggy and harness - 40 head of hogs, 11 cattle, 15 sheep, 1 mule and 4 horses. To have and to hold the said lots, pieces or parcels of land and every parcel thereof assigns forever, and the said Thomas Smith for himself, his heirs, executors and administrators, and for and in behalf of the said Nancy F., his wife and his heirs, with comvent, promise, grant and agree to and with the said Thomas Books his heirs and assigns?????. That the said Thomas Smith and his heirs, the said lots, pieces and parcels of land and premises hereby granted be, with the personal property above described, unto the said Thomas Brooks his heirs and assigns against him, the said Thomas Smith and his heirs, and against the heirs of the said Nancy F. !8 May 1870: To Thomas Smith, Jr Trustee for Ann F. Smith, 366.65 acres (Willow Grove), by deed dated 8 May 1870: This deed made the 8th day of May for the year One thousand eight hundred and seventy between Thomas Brooks of the County of Mathews and State of Virginia of the first part and Thomas Smith, Jr., trustee of the second part, and Ann F. Smith, wife of Thomas Smith, Sr. (sic), of the aforesaid County of the third part. Withnesseth that in consideration of the love and affection which the said Thomas Brooks hath and beareth for his sister the said Ann F. Smith, and for and in consideration of the sum of One dollar, good and lawful money of the United States the said Thomas Brooks in hand paid by the said trustee at or before the sealing and delivering of these presents, the receipt whereof is hereby acknowledged he, the said Thomas Brooks hath granted, bargained, sold, aliened, released and confirmed by these presents doth bargain, sell, alein, release and confirm unto the said trustee, his heirs and assigns a tract or parcel of land situated, lying and being the County of Mathews containing 366.65/100 acres be the same more or less together with the following personal estate Viz. Household and kitchen furniture, farming utensils, 1 buggy and harness, 40 hogs, 11 cattle, 15 sheep, i mule and 4 horses, it being the same property both real and personal which was conveyed to the said Thomas Brooks by Thomas Smith and wife by deed bearing date on the 3rd day of December 1867 and of record in the Clerks Office of the county aforesaid, with the exeption of one hundred and twenty acres of land South and West of the house. To have and hold the said piece or parcel of land and personal property herein described unto the said trustee, his heirs, and assigns. Upon trust, he the said trustee, his heirs and assigns shall permit the said Ann F. Smith to occupy, possess and enjoy, and in every way to have the complete management and control with the rights of disposal of the said land and personal property, free and clear of and from all debts and contracts of any and every description whatever of her said husband, Thomas Smith, now existing, or which at any timer heretofore may exist; it being the express intent and meaning of the said Thomas Brooks to transer said property, real and personal to the said trustee for the exclusive and absolute use and benfit of the said Ann F. Smith as though she were a femme sole, entirely free and clear of and from any marital rights whatever of her said husband. And the said Thomas Brooks of the first part, his heirs, executors, and administrators doth covenant, promise and agee to and with the said trustee of the second part, his heirs and assigns,by these presents in manner and form following to with: that he the said Thomas Brooks the said piece or parcel of land and personal property hereby given or intended so to be, unto the said trustee for the benefit of the said Ann F. Smith of the third part as aforesaid, against all and every person or persons whatever will warrant and forever defend by these presents.
