    State of Kentucky, Owen County.
    On this 2nd day of September 1836 personally appeared before me Jacob H. Smith a Justice of the peace in and for the County of Owen County, state of Kentucky and one of the Judges of the Owen County Court Margaret Ball (formerly Margaret Bray) a resident of Own County state of Kentucky aged Eighty three years who being first duly sworn according to law doth on her oath make the following declaration in order to obtain the benefit of the provision made by the act of Congress passed July 4th 1836.
    That she is the widow of James Ball who was a private soldier in the army of the revolution that her husband the said James Ball enlisted as a soldier in the service of the United States in Virginia and served until the close of the war. She will not undertake to state the service of the said James Ball her late husband as he was a revolutionary pensioner of the United States that he drew a pension under the act of Congress passed in the year 1818 that his Jas Balls original certificate is now in her possession is herewith filed with the papers as evidence in her case. She further declares that she was married to the said James Ball in the month of May in the year Seventeen hundred and seventy one or seventy two in the county of Hampshire, state of Virginia where they lived at the time. Her husband the said James Ball entered the service she will further state that they were married before the commencement of the revolutionary war she will further state that she still has the original record of the birth of her children and the said James Balls. She is confident that the age of the children are all correctly there set down and she will state that her memory may have failed her on many points but as to the marriage of her and the said James Ball she is certain and knows that they were married before he enlisted that they had a son born in 1775 that he is now living, that he lives in Jessamine county Kentucky unless he has lately died. She will further state that her husband the sd James Ball departed this life on the 27th day of March 1830 in Owen county Kentucky and she will further state that she has remained a widow ever since the death of her husband the sd James Ball as will more fully appear by the proof hereunto annexed, she will further state that from her old age she is certenly disabled from attending in open court to make her declaration.     Sir.
    My Mother, Margaret Ball, widow of Jas Ball was a pensioner of the United States at the rate of $80 per year. She died on the 29th of August 1842 leaving a large family of children. Some of whom live in this County, some in Nelson County Ky, and others living in other States, scattered as it were to the four winds. I administered upon her Estate in the fall of 1842 and supposing that as admst I had the legal right to the balance due her at the time of her death. I made the necessary proof of her death & casualty and gave my power of attorney to draw the money from the pension agent at Louisville. The money was not paid and for the reason that by the law the children and not the agent is entitled. This, at all events was the reason assigned. The amount due of the pension is quite small being a fraction less than $40 and it would cost that amount or near it in money and trouble to procure the necessary powers of attorney from the children to allow me to draw the money.
    My Mother left some personal property and at the time of her death owed comparatively nothing, only a few dollars, which have been paid and there is a surplus in my hands to be divided amongst the children. And if this little balance could be attained the sum to be divided would be increased by that amount. If it came to my hands as the adm I would be bound by my bond to distribute it equally and would have the inclination to do it. And it does appear to me under the whole circumstances that this be paid over to me without any impropriety it is so done. The money will be lost to us. We are all quite poor and small as the amount is it would be very acceptable & serviceable. May I venture to ask you to direct this payment by the pension agent at Louisville? I can only appeal under the circumstances to you and ask you to give some consideration to the case and direct that to be done in the case which you think right. Yours. Jacob Ball.
