    This indenture made this seventeenth day of January in the year of our Lord One thousand eight hundred and fourteen Between Lewis Bly & Sarah his wife of the Town of Norway in the county of Herkimer and State of New York, of the one part, and Benjamin H. Bly, of the town, county and state aforesaid of the second part: in consideration of the sum of two hundred and twenty five dollars to them in hand paid by the said party of the second part, do grant bargain, sell ... unto the said party of the second part...that certain piece of land situate lying and being in the Third allotment of the Royal Grant, and in lot number thirty nine. ....Signed Lewis Bly and Sally Bly.     Benjamin Bly Males: 1 under 5, 1 at least 5 and under 10, 2 at least 10 and under 15, 1 at least 30 and under 40. Females: 2 at least 5 and under 10, 1 at least 30 and under 40.


    Death date has been listed as 12 Jan 1853 by some people. Location supposedly an unmarked grave. I have had trouble reconciling this with the absence of Harvey in the 1840 and 1850 census and the Herkimer Co. documents that give his residence as Indiana. I never considered that I was seeing evidence from two people. I was wrong to conclude that Harvey and Mary Miller Bly got a divorce and Harvey remarried. I found a new piece of evidence that Harvey was the oldest son of William and his second wife Isabelle Tefft Bly and Benjamin H."s brother. I am very sorry if this has confused or disturbed anyone. If you have copied this mistake of Benjamin H. Bly having two wives, please correct it.

    "Harvey Bly the second son of William and isabelle Bly was born at Bergen, NY in 1804, probably when his mother was on a visit there as we find no record of the William Bly family ever living there. Harvey probably lived in the Town of Norway NY until May 10th, 1837 when he married Amanda E. Simons at LeRoy, NY. The witnesses were A. E. Wilcox and Uriah Compton. After marriage they went to the State of Indiana and later to Olio where they settled on an 80 acre tract of land where he died in his 89th year. He was a blacksmith by trade. They were the parents of seven children. Children Bly: Mary Charlotte, Helen Eudozia, Isabelle Ann, Sarah Lavina, Harriette Emaline, William Silas Walter, Caroline Elizabeth. "

    Benjamin H. Bly b. c. 1795 son of William Bly m. Mary Cummings b. c. 1795 daughter of Jacob Cummings and Mary Franklin. Mary Cummings identity is known from the pension application of her widowed mother (pension file W 3517) when during the proceeds of that application on 30 May 1846, "Mary Bly deposed she was 'upwards of fifty years,' that she was the 'third child? of Jacob Cummings and Mary Franklin. In a later deposition dated 20 July 1853 she stated she m. Benjamin H. Blye and that she was his widow and was residing at Jackson Township, Tioga County, Pennsylvania. Benjamin first appears on the 1819 assessment list (compiled late fall of 1818) of Jackson. Enumerated in Jackson in 1820 with two males under age ten (b. 1811-20) and one male of age twenty six and under age forty five (b. 1776-94). Mary was not enumerated in the household. Their residence was in the area of Jobs Corners. Benjamin last appears on the 1823 assessment list (compiled fall of 1822) and may have appeared on the 1824 list but it is missing. He does not appear on the 1825 list. Enumerated in Norway, Herkimer County, New York in 1825 with seven members in the family. Enumerated in Norway in 1830 with one male under age five (b. 1826-30), one male of age five and under age ten (b. 1821-25), two males of age ten and under age fifteen (b. 1816-20), one male of age thirty and under age forty (b. 1791-1800), two females of age five and under age ten (b. 1821-25), and one female of age thirty and under age forty (b. 1791-1800). They returned to Jackson Township and on the 1834 assessment (compiled fall of 1833) unable to pay for schooling of children Charles, Olive, and Daniel.

    Mary was enumerated in Jackson Township in 1840 with one male of age five and under age ten (b, 1831-35), one male of age ten and under age fifteen (b. 1826-30), one male of age fifteen and under age twenty (b. 1821-25), two males of age twenty and under age thirty (b. 1811-20), one female under age five (b. 1836-40), one female of age five and under age ten (b. 1831-35), two females of age fifteen and under age twenty (b. 1821-25), and one female of age forty and under age fifty (b. 1791-1800). Mary was enumerated in the household of son Alonzo in Tioga Township, Tioga County, Pennsylvania in 1850. Mary wife of B. H. Bly d. 9 Jan 1863 67y (ts) Miller Cemetery, Jackson Township.

    "I give and bequeath to my eldest son now living, Harvey Bly the sum of fifty dollars to be paid him in five years after the decease of my beloved wife." 18 August 1845.
    So Benjamin H. died before 1845 because he already was dead when his father died, and he is absent in the 1840 census, so he probably died before 1840.
