    Written 13 Feb 1794, In the name of God amen, I John ROCHELL of the Parish of St. Lukes and Co. of Southampton, being sick and weak of body but of sound mind and memory thanks be given to Almighty God, for the same do make and constitute this my last will and testament in form and manner following:
    Imprimis: I lend to my loving wife Judith the use of all my lands and plantations in Southampton Co. as also all my personal estate. Bonds, notes and private accounts during her life or widowhood to use the same and profits therof after payments of my debts as she may think proper, but should she marry, I give liberty to make use of such timber only on the land and tenements as is sufficient for the use of the Plantations.
    I also lend my wife Judith the use of all my slaves for the term of twenty years or till marriage for the support of herself and the education and support of my children but should she marry or survive the term of twenty years from the date hereof in either case, I lend her the use of the following slaves only, viz SAM, DICK, FRANK, GREAT NED, DAVY, OLD HANNAH, TABB, LUCY, PATIENCE, YOUNG HANNAH and EASTER.
    My desire further is that should my said wife marry or survive the term of twenty years all my negroes not herein particularly named shall be hired out for the common benefit of ALL MY CHILDREN that in the town of Petersburg Prince Town, as also my fisheries on the Chowan and Meherrin Rivers.
    My Will is that they be rented out yearly and the profits arising therefrom be divided equally between my wife and such of my children as may be then living, but my will further is that in renting out my lands in Sussex Co., Va. and Halifax Co, NC. No timber shall be made use of more than for the necessary support of the several plantations theron, nor any more lands cleared on either.
    Lastly, at the decease of my wife, Judith, my will is that the whole of my estate that is then left be equally divided between such of my children as may be then living or the heirs of such as be dead, if any draw a parents part.
    I hereby appoint my brother Levi ROCHELLE Exec. of this my last Will and Test. allowing him 5% for trouble in settling my estate or should he die before my estate is settled, I appt. my friend James BUTTS to succeed him as my exec. to whom I allow the same 5% for what part shall remain unsettled.
    In witness whereof I have hereunto set my hand and affixed my seal this 13 day of Feb. 1794. John ROCHELLE (SEAL). Wit: Geo. GURLEY Jeremiah DRAKE Stephen HANDCOCKE.
    At a court held for the Co. of Southampton the 10th day of April, 1794. This Will was proved by the oaths of Geo. GURLEY, Jeremiah DRAKE and Stephen HANDCOCK, the Witn. thereto and ordered to be recorded and on the motion of Levi ROCHELLE the Exec. Therein named who made oath and probate is granted him in due form giving security whereupon ack. Sam KELLO Clerk.
