" I never expected to find so many Indian connections, or to hear that John Carroll had to go into "seclusion" in the hills for about 17 years after he "bit Sol Leaves's ear off in a fight, which was a penitentiary offense" (this is from Benjamin Franklin's claim in CHEROKEE BY BLOOD). B. F. cited this fact--that John Carroll wasn't living in the family home (or at least not when anyone could catch him there)--as the reason Jane Walls never claimed Cherokee heritage in 1835, since she was afraid if she did, she'd have to leave the area, and wouldn't be able to tell him where she was." John C. Payne, born in Franklin County, Georgia sometimes between 1790-1800, according to the 1830 Census data. One piece of information says 1801 His son, A.T.W. was appointed administrator of his estate in August of 1865. Rabun County was formed out of Franklin County, and this may have been where he was born. Most records indicate his wife's name as Jane or Susan (perhaps Susan Jane). She was the daughter of Henry Walls and Suse (Susan) Powhattan Watters, a Cherokee Indian.
Family tradition says that John C. Payne came to Tennessee from Rabun County, Georgia (This means he left there after 1820) and that he came up the Tennessee River to Louden, Tennessee. He is supposed to have surveyed the road from Tellico Plains, Tennessee to Murphy, North Carolina. It was known as the Murphy Turnpike. He reportedly died at Louden, Tennessee about 1863. This date agrees with the fact that A.T.W. Payne later was appointed Administrator of John C. Payne's estate. [Children are listed as from family date and from two Eastern Cherokee Indian Claim applications] Source: Volume II by Paul Long
Note: All Payne claims were poorly written, were sometimes incomplete, and sometimes information was written on the wrong lines, and were rejected, as the older generations did not register.
