    did give and bequeath to his Daughter the sum oftwenty pounds sterling and that WILLIAM GARNER, Executor of the Will, refused the payment thereof, and WILLIAM being called and saying nothing in barr ofthe Petition, upon motion of STEPHEN &JANE JOYCE Judgment is granted them against WILLIAM GARNER for the sum oftwenty pounds sterling and it is ordered he pay the same with costs als Execution

    THIS INDENTURE made the 25th day of February in the 18th year of the Reign of our Sovereign Lord George the Second by the grace of God of Great Brittain France and Ireland, King, Defender of the faith &c., And in the year of our Lord God 1744; Betwen WILLIAM MOORE of Parish of Cople in County of Westmoreland, Planter, and REBECCA his Wife of one part and JAMES BAILEY of the same Parish and County, Planter, of other part; Witnesseth that in consideration of the sum of Two thousand five hundred pounds of tobacco to WILLIAM MOORE in hand paid by JAMES BAILEY, the receipt whereof WILLIAM MOORE doth hereby acknowledge, hath and by these presents WILLIAM MOORE and REBECCA his Wife doth bargain and sell unto JAMES BAILEY his heirs all that parcel of land situate in Parish of Cople and County aforesaid containing by estimation Sixty six acres be the same more or less being the Plantation now in the
    occupation of said WILLIAM MOORE, formerly purchased by one PATTY HAILE of one STEPHEN SELF and JANE his Wife, and by them conveyed to PATTY HAILE by Indenture of Lease and Release bearing date the 18th & 19th days of September in the year of our Lord 1714, and afterwards sold and conveyed by PATTY HAILE to JOHN FROUD (Father of WINIFRED MARMADUKE, Wife of JOHN MARMADUKE) by Indenture of Feoffment bearing date the 24th day of September 1717; which JOHN FROUD in and by his Last Will and Testment in Writing bearing date the 4th day of March in the year 1717, gave and devised the same to the aforesaid WINIFRED in fee simple, which land one JOHN MARMADUKE and his Wife. the aforesaid WINIFRFD. sold and conveyed to JAMES McDANIEL by Deed of bargain and sale bearing date the last day of July in the year of nor Lord 1741. and JAMES McDANIEL by Deed of Feoffment bearing date the 21st day of February 1742 sold and conveyed the same to WILLIAM MOORE, which Sixty six acres of land was
    first devised and given to JANE JOICE in and by the Last Will and Testament of her Father, JOHN GARNER, as by the several Conveyances and Wills proved and recorded in the Court of County of Westmoreland may more fully appear; And all houses orchards profits and appurtenances belonging; To have and to hold the parcel of land and premises with appurtenances unto JAMES BAILEY his heirs; And WILLIAM MOORE and his heirs the premises unto JAMES BAILEY his heirs shall warrant and forever defend by these presents; In Witness whereof the parties to these presents have interchangeably set their hands and seals the day and year first above written

At a Court held for the said County the 26th day of February 1744 WILLIAM MOORE and REBECCA his Wife (she being first privately examined according to Law relinquished her right of Dower to the land herein conveyed) personally acknowledged this Deed of Feoffment for land by them sold and conveyed to JAMES BAILEY to he their act and deed, And the said WILLIAM MOORE also personally acknowledged the Livery of Seizen and Receipt endorsed to be his proper act and deed, which un motion of the said BAILEY are admitted to Record

    KNOW ALL MEN by these presents that I WILLIAM MOORE of Cople Parish in County of Westmoreland, Planter, am held and firmly bound unto JAMES BAILEY of the same Parish and County, Planter, in the sum of Five thousand pounds of tobacco to which payment well and truly to be made I bind myself my heirs firmly by these presents; Sealed with my Seal and dated the 25th day of February 1744 and in the 18th year of the Reign of our Sovereign Lord George the Second &c.
    THE CONDITION of this obligation is such that if WILLIAM MOORE his heirs shall perform and keep all Covenants which on his or their part ought to be performed and kept particularly expressed in one Deed of Bargain and Sale made between WILLIAM MOORS and JAMES BAILEY according to the purport of the said Deed; Then this obligation to be void and of none effect, otherwise to be and remain in full force power and virtue
