The Thayer News, Fri, Sept 5, 1947:
"Marvin Gibson charged with manslaughter death of Emmett Willard -
Marvin Gibson and Albert Stinnett were in the custody of Sheriff Caruthers, Prosecutor Gullic and Jimmie Howard Thurs morning being taken to Alton where manslaughter charges were filed against Gibson. The charges arose from a car accident which occurred about 1 o'clock Thurs morning, in which Emmett (Josh) Willard, about 42, of the Rover community was killed when the car driven by Gibson overturned. Officers believe that Gibson accompanied by Albert Stinnett and Willard were all drinking and that Gibson was taking Willard to his home when the car overturned on the Rover road just off Hwy. 63. All 3 men were thrown from the car and Willard was pinned under crushing his chest. Gibson has been at liberty pending an appeal on a 3-year sentence in the death of Mrs. Mollie Nelson on July 4, 1946. Gibson was driving an army panel job which belonged to Clyde Stuart. Officers say the car was not damaged a great deal."
[Gibson was later acquitted of the murder charge]

The Thayer News, Thayer, Mo, Oct 3, 1947, p1 --
Marvin Gibson acquitted of murder charge --
Marvin Gibson, of Thayer, a young brakeman for the Frisco railroad, who was arrested Sept 8, on a second degree murder charge growing out of an automobile accident in which Emmett Willard of Rover was killed, has been acquitted of the charge. Willard was riding with Gibson in the Gibson car when it turned over off Hwy 63 just north of Koshkonong on Sept. 4. Officers charged that Gibson was intoxicated at the time and that the accident resulted from his careless and reckless driving. The case was tried before Magistrate Judge T.W. Mesara in Alton last week, and the trial resulted in acquittal for Gibson. Gibson contended that he was not intoxicated at the time and that the accident was not the result of carelss driving. He was defended by Green and Green of West Plains. A charge of drunk driving was filed against Gibson following the fatal accident, also was dismissed in Magistrate court in Alton last week. Young Gibson who is a son of Dexter Gibson, a Frisco engineer, already was under a 3-year sentence for manslaughter, having been convicted in a trial in Howell county circuit court, on a charge of manslaughter in connection with the slaying of Mrs. Mollie HOgan Nelson in Thayer in July, 1946. Both he and his mother were charged with the slaing of the Nelson woman, but the mother has not yet been tried. The case was taken to Howell county on a venue change appeal in the supreme court of Missouri and is now pending in the state.
