    This Indenture made the tenth day of December in the y ear of our Lord one thousand eight hundred and one betwee m James Dougherty of the County of Jefferson and State of T ennessee of the one part and Thomas Kinkaid of the County o f Anderson of the other part WITNESSETH that the said Jame s Dougherty for and in consideraton of the sum of $280 to h im in hand paid the receipt where is hereby acknowledged an d by these presents doth grant bargin sell aline enfeoff an d confirm unto the said Thomas Kinkaid his heirs and assign s forever a certain tract or parcel of land containing 50 0 acres lying and being in the County of Anderson on the No rth side of Clinch River where an Indian path that crosse s Clinch River at the paughpaw ford passes through said lan d close by three particular springs heading within a shor t space of each other, a quantity of ground suitable for me adow lying below said spring beginning at two black oaks an d running North 55 E 300 poles to a stake thence N 5 degree s E 267 poles to a stake thence S 45 degrees W thence (thre e?) hundred poles to a stake thence a direct course to th e beginning which tract of land was granted to the said Jam es Dougherty the 24th day of December 1792 and registered i n Knox County ....

    I, Thomas Kincaid, of Campbell County and State of Tennesse e, being weak in body, but of perfect mind and memory, bles sed be almighty God, do hereby make and publish this my las t Will and Testament in manner and form following, that is , first I will and bequeath to my daughter, Sarah, one ba y mare known by the family by the name of Pegion and one be d and furniture and one good cow. Secondly I will and beque ath to my son Wiatt one sorrel horse known by the name of B randey and one bed and furniture and one good cow. Thirdl y I will and bequeath to my son, Thomas, one sucking hors e colt, a sorrel and one bed and furniture and one good cow . Fourthly I will and bequeath to my daughter Nancy Young o ne good young horse beast, and one bed and furniture and on e good cow. Fifthly I will and bequeath unto my wife, Marth a Kincaid, all the balance of my personal property during h er lifetime. Sixthly after the death of my wife Martha Kinc aid, I will and bequeath my tract of land where I now liv e to my three sons, William, Wiatt and Thomas Kincaid, to b e equally divided between them all. Seventhly I will that a fter the death of my wife, as before mentioned, that all th e rest and residue of my personal property be sold on twelv e months circuit and after collected equally divided betwee n my seven daughters, to wit: Anne, Polly, Martha, Peggy, B etsy, Sarah and Nancy Young, and lastly I do hereby constit ute and appoint my friend William Kincaid Senr. the Executo rs of this my last will and testament, hereby revoking al l former wills by me made.

    Homer Jones, Kincaid researcher of the 1950's, felt that on e of Thomas Kincaid's daughters married Robert Dempster, on e James Cooper, and one David Proffitt, and one Dangerfield ? Williams.

    Since Thomas md. in Bath Co. without permission on 19 Mar 1 794, then he was aged 21 or older on that date. This implie s that he was eligible for paying taxes by that point. A Th omas Kincaid (with no claim that this is he) appears on th e Bath Co. tax lists from 1795-1800 only, after which he di sappears as a neighbor to Joseph. Since there is no widow M artha on the tax lists of Bath Co. at this era, it's an ass umption that he moved. This Bath Co. Thomas was always list ed on the Bath Co. tax lists adjacent to a Joseph Kincaid

    Birth date based on TN tax records. Thomas is on the 1820 t ax rolls, hence under 50, he is not on the 1821 tax rolls , hence over 50. He was therefore born between Mar 1770 an d Mar 1771.

    Thomas' will was written/signed on 2 Jun 1830 and was "prov ed" on 13 Sep 1830.

    In 1813, just seven years after Campbell County was establi shed, a petit on was filed with the house of Representative s of the Tennessee State Legislature to change the locatio n of the county seat at Jacksborough.

    The petition contained 249 names and was filed to locate th e county seat closer to the Claiborne County line. The pet itioners complained that, "They said seat having been unjus tly settled within four miles.of Anderson County, where a s the distance to Claiborne County is seventeen miles."

    No doubt the petitioners were mostly, if not all, located i n Powell's Valley. The petition was referred to committe e and went nowhere. It is signi ficant, however, by reveal ing that in 1813 there were 249 residents of Powell Valle y wanting to bring the county seat closer to them. Most im portantly to us it shows the names of some of the early set tlers in the area. The reader may want to look at the name s listed on the petition to identify ancestors who were amo ng the county's earliest residents.

    Daughter Anne Kincaid was born 01 Sep 1795 in Washington Co ., VA, married Ericus Smith, son of Ali Smith and Jane Den ny in Cambell County, TN. Anne and Ericus had 15 children . Anne died 02 Sep 1866 in Campbell Co., TN.

    Daughter Mary Kincaid was born 06 Oct 1796 in VA., marrie d William Miller, son of John Miller and Hannah Young (youn ger sister of aunt Nancy Young Kincaid, in Campbell County , TN. Mary and John had 5 children. Anne died in 1827 i n Campbell Co., TN.

    Son William Kincaid was born 1798 in VA., married Sarah Gle nn, daughter of Robert Glenn and Agnes Nancy Denny. Willia m and Sarah had 11 children. William died before 13 Mar 18 72 in Caldwell Co., MO.

    Daughters Martha Kincaid was born 1799 and Margaret Kincai d in 1802 in VA. Nothing else in known about them.

    Daughter Elizabeth Kincaid was born 18 Dec 1805 in Campbel l Co., TN, married Ezikel Smith Jones, son of Isaac V. Jon es and Rhoda Smith in Cambell County, TN. Elizabeth and Ez ikel moved to KY. and had 5 children. Elizabeth died 18 D ec 1877 in Knox, KY.

    Daughter Sarah Kincaid was born in 1808 in Campbell Co., TN , she married James Cooper in Campbell County, TN. They h ad at least 3 children. Sarah died Feb 1842.

    Son Wyatt Kincaid was born 04 Jul 1810 in Campbell Co., TN . He married Rachel Collett, daughter of Andrew Collett an d Phoebe. Wyatt and Rachel had 8 children. Wyatt and Rach el moved to Platt, MO where Rachel died 4 April 1848. Wyat t married 2nd wife Isabella McKay, and had 6 children. Wya tt died on 16 Dec 1891 in Washington, NE.

    Son Thomas Kincaid was born in 1814 in Campbell Co., TN. H e married Louisa Sharp, daughter of John W. Sharp and Winif red Kirk in Union Co., TN. Thomas and Louisa had 10 childr en. They moved to IL with the Sharp family where oldest so n John Sharp Kincaid was born, then moved back to Campbel l Co.TN, where daughters Martha W.Kincaid, and Winifred Kin caid, was born. Thomas and Louisa then moved to Ray Co., M O. with other Kincaid families and families from the Campbe ll and Claiborne Counties in TN also located. Their remai ning 7 children, Sarah Ellen, Serilda, Louisa, James, Marti n Alexander, Margaret Ann, and William S. Kincaid were al l born in Ray Co., MO. Thomas died 6 Nov. 1859 and is in t he 1860 census. He is buried in the Old New Hope Cemetery i n Ray County, MO.

    Daughter Nancy Young Kincaid was born 26 Feb 1818 in Campbe ll Co., TN, married John Major Grimes, son of George Grime s and Nancy Carlock on 4 June 1843, in Cambell County, TN . All 5 of Nancy and Johns children were born in TN. The y later moved to Ray Co., MO. where Nancy died on 26 Aug 18 98. She is buried in the Kincaid Cemetery, Knoxville, Ra y Co., MO.
