  • Note: Joseph had migrated from North Carolina to Lumpkin County, Georgia, by 1836.  Land records showed that he bought property in Gilmer County on Jun 6, 1839 from Benjamin West.  It was a 160 acre farm in the Cartecay community where he and his family lived until the death of first wife, Rebecca Blackwell Anderson in 1851.  John and Rebecca were members of Ebenezer Baptist Church. 4

    Gilmer County In the name of God, Amen
    I Joseph Anderson of the county of Gilmer and state of Georgia being of sound mind and memory and considering the uncertainty of this Frail and Transitory life do therefore make ordain publish and declare this to be my last Will and testament  That is to say first after all my lawful debts are paid and discharged The residue of my Estate real and personal I give and bequeath and dispose of as follows

    To wit

    To my beloved Wife the farm on which I live it being lot number Two hundred and seventy seven Sixth District and second section and one half more or less of Lot Number Two hundred and sixty four.  The other portions of said last mentioned lot having been sold to Jacob Bearden.  My Executors herein after named will make titles to him for the same

    I further will and bequeath to my beloved wife Millison Anderson all the House hold and Kitchen furniture with the understanding that she gives my children severly one bed each at such time as they may require it and such furniture as she may be able to spare them.  I also give and bequest to her two cows and calves that she may select out of my stock also one spotted sow and five shoats and four large hogs which she can select also one gray mare six years old and gearing and _____ sufficient to carry on the farm and one hundred dollars in money and all the crop of the present year and provisions for this years  The above property I will and bequeath to her during her natural life or widowhood   at her death or marriage the same is to be equally divided between my four youngest children (viz) Reuben Floyd Anderson Jackson Marion Cisero Flavious Josephus being my only heirs by my present wife Milison Anderson  To my sons Ensly M Anderson Jediah L. Anderson I will and bequeath Lot of land Number Two hundred and Twenty six and Two Hundred and Twenty seven both in sixth district and second section of Gilmer county  To my son Joseph C Anderson I will and bequeath Lot Number Two hundred and five in the six district and second section of said County of Gilmer  to my sons James W. Anderson and Benjamin H. Anderson I will and bequeath Lots of land Number Two hundred and Twenty eight and Two hundred and Forty one both in the sixth district and second section of said County of Gilmer.  To my sons William C and John W Anderson I will and bequeath Lot of land Number Two hundred and Seventy nine and the south half of Lot Number Two hundred and seventy eight in the sixth district and second section and one hundred dollars each in money

    Exclusive of what I shall hereafter will them in a division of other property to my Daughters Martha T West and Nancy Angeline Fereby I will and bequeath Four Hundred and fifty dollars each  To my Daughter Eliza Rebecca I will and bequeath Five Hundred collars  All the ballance of my property both real and personal I wish to be sold on twelve months To be done with note and security and the profit of the same to be equally divided amongst all my children  My Executors herein after mentioned will let the balance of the Hogs remain for the use of the family the next year and they are further authorized and instructed to execute titles to Wm Southern to half of Lot Number Two hundred and Forty three sixth district and second section When he pays certain notes I had advanced him for said lot  likewise I make constitute and appoint Benjamin C. West and James Fariba to be Executors of this my Last will and Testament hereby revoking all former wills by me made.

    In witness whereof I have heretofore set my hand and affixed my seal on this the Eighteenth day of April Eighteen Hundred and Sixty one
