    Deposition of Abraham Endsley: The following was all the evidence given on the trial of the above cause, Abraham endsley a competent witness being duly sworn testified that he had been acquainted with the family of Casteel for 15 years, that Nathan Casteel separated from his family in the fall of the year 1835. heard him say before he went off that there was a large amount of money coming to his wife in Ohio and that he was going for it, that he left his family on sixty acres of land 12 or 14 acres improved, left a family of four boys and one girl & his wife Mary Casteel, they were reputed to be husband and wife which fact was admitted by the defendant, defendant has not been back since. The health of defendants wife was bad she was in bed when he left. She was sick one fourth of the time (illegible) the defendant was gone. Four years after he went from home James Casteel one of the boys left home. George Casteel left soon after him. for the last five or six years William has been the principal manager of the place and has supported the family, defendant was in debt when he went off. I know of payment being made, these debts were paid out of the labour of the family and the proceeds of the place and they paid the tax. The plaintiff was 24 years old last December, the old lady Mary Casteel died last spring. William was the head of the family and attended to the affairs. William gave directions to have the funeral expenses paid for, plaintiff ordered a coffin and

    produced a receipt for $8.00 and burial clothes $5.50. also paid Richard Swain $2.00, paid by witness $10.75 and a tax recipt for $2.00 was produced. James Casteel was 12 years old when the old man ran off. Elizabeth 8 or 9, Andrew J. 2 or 3 the children were al raised on the place except James who left home when 14 years old. James never worked for the family, James once said his mother might die and be damned. William's services were worth for the last 3 years in taking care of his mother $150.00 per years, and before that time from 50 to $75.00 per year. For the last six years, for 18 months before the wife of defendant died her health was very bad William waited on her, William has cleared 8 or 10 acres of land since the old man left, it was worth $50 or $60 to clear that and put it into cultivation. William has done the work for the last six years. William furnished everything. Witness lived 4 or 5 miles from the family for the last 10 years.

    Cross Examined
    The kitchen work was done by the little children at the time defendant left, witness was living in the house with defdt. Witness married a half sister of plaintiff, Mary Casteel's daughter and was married when he ran off. the girl assisted in nursing her mother. William Casteel has been married about a year, he worked some for me, I gave him 50cts per day for it. the wife of defendant was so bad, that the plaintiff could leave but a little while at a time, William had two severe spells of sickness. The plaintiff sold me two knifes, one for $3.00 - the other for $4.00. The defendant had when he went off & left a ___ plough, worn out double hers(?) worth 2 or 3 dollars One cow and one or two calves, two sows with young pigs. had but little in the inside of the house. The old man has made no provision for his family since.

    This serves as the additional proof that William Casteel is a child of Nathan, as this land was bought by Nathan 4 Feb 1832. There is no probate on Nathan, nor any title change recorded in Fountain Co, but the sale does go unchallenged, so title is clear.

    "Know all men by these Presents, that Isaac Shaw of the County of Lykins Kansas Territory for and in consideration of the sum of Four Hundred and forty Dollars in hand paid to him by William Casteel of said County the receit whereof is hereby acknowledged, have bargained sold and conveyed, and by these presents do grant bargain, sell and convey unto the said William Casteel and to his heirs and assigns forever, the East half of North West quarter of Section No. 9 Nine, in Township No Seventeen (17) of Range No Twenty Five (25) of Land situated in said County of Lykins. To have and to Hold said above described premises unto the said William Casteel and to his heirs and assigns forever. And the said Isaac Shaw for himself, his heirs, assigns and administrators covenants and agrees with the said William Casteel his heirs assigns and administrators that he is lawfully seized of said premises, and has good right to sell and convey the same, and that he will forever warrant and defend said above described premises unto the said William Casteel and to his heirs and assigns forever, against the lawful claiming of all persons whomsoever.

    Note that on the same day & with the same witnesses, Isaac Shaw conveyed to Mary Ann Casteel the adjacent property (West 1/2 of NW quarter of Sec of 9, Twp 17, Range 25, eighty acres). This Mary Ann seems to be the wife of Jacob Casteel to whom William is to sell this land shortly.
    This is supported by a later deed of 14 Jun 1860 in which Jacob Casteel and wife Mary Ann sell the NW quarter of Sec. 9, Twp 17, Range 25 to David Miller, again with B.F. Simpson--and the registrar of deeds A.J. Shannon--as witness.

    Land description in Miami Co, KS SWSE & E1/2SE of Sec 8, Twp 17, Range 25. 120 Acres. Value of real estate in 1863 tax assessment $240. Value of personal property $237. With widow's exemption, tax owed, $.50(that's correct)

    No probate exists for his death period in KS--confirmed with county--The infamous abolitionist John Brown [who attempted capture of the national arsenal at Harper's Ferry and was hung for his efforts just before the outbreak of the Civil War] lived in the area (at Ossawatomie) and brought in other like-minded settlers. This exacerbated the Border Wars which culminated in the sack of Lawrence, KS by Quantrill's Raiders 21 Aug 1863. It is certain that the Casteels saw the Jayhawk-Rebel clashes with their own eyes; it is possible that they were in some way involved, especially given the early death of William in 1861. There also exist first-hand accounts of the murder of several uninvolved farmers of this county by Rebel guerillas. No farmers' names are given.

    Letter from Floye Beesley (granddaughter of Mary Ann Casteel Luce)--says that Mary Ann said her father was killed by bushwhackers. Floye lived with her grandparents from early childhood (after her own mother died), so this has possibilites for being correct. Look in Kansas and MO newspapers to try to confirm.

    Note that household 825 is that of N. Dagenett (age 31, b. MD) & wife S.J.(hard to read, 26, b.OH) show children K. (female, age 3, b. KS) & Coon (illegible, may be Cora, female, age 2, b.KS)---also shows E.E. Hadeley (female, age 10, b.IN) & Alice (female, age 8, b.IN). This could be a 2nd marriage and may well be Nancy Titus Casteel's missing sister Sarah Ann, who 1st md. Washington Headley, who was decd. by 1854. William Casteel is buried in Dagenett Cemetery.

    That affiant was personally present at the birth of Charles Cassteel a son of the said William and Nancy Cassteel. That said Charles Cassteel was born December 10th AD 1855.

    Elias V. Casteel (or Castile) son of Nancy Titus Castile and William Casteel. He was about 12 years of age, when his father was killed early in Civil War. This Photo taken from an old picture of him in his early 20ties he was born 1848 or 49, in state of Ind. his people (near boonsboro) traveled over land when he was a small boy, to Kans, they had a homestead just 8 miles from eastern kans line. his Dad a Union Soldier was killed just over the Mo. West State line by Southern Men. (Quantrills Men) William Castile was a mason, but the man named Briggs who comanded the S. Men who killed him, all so a Mason, refused to give him his life. written by Stella (Casteel) McDaniel.
