Note: Josiah Ogburn's first deed was the $1,200 purchase of 385 acres on the north side of the Cumberland River in Montgomery Co., TN, in May 1820. These two tracts adjoined the lands of Joseph Bowers, William & Samuel Mitchell, James Smith, Jesse A. Brunson, and Jacob Baylis. Josiah was a resident of the county at the time. His name is mistakenly given as "Joseph" in the early part of the deed but was correctly shown as Josiah near the end, with a note of the mistake just before the seller, James Trousdale, signed with his seal. No land sale for Josiah was found in archived Montgomery Co. deed records researched for me by Melissa Barker.
The only other deed found was a deed of Trust on 12 Aug 1826 from James Smith to Josiah Ogburn who provided security for James Smith in a suit brought by Patrick Henry against Smith. In return, James Smith gave Josiah several slaves that would be sold by Josiah only if Smith lost the suit.
The late Josiah Ogburn's heirs are named in his father's 1839 will. Josiah Ogburn of Montgomery Co., TN, signed his own will on 4 Oct 1829. His brother, Thomas Ogburn, posted bond and was appointed Executor of Josiah's will on 19 Oct 1829. Mathew Ogburn, likely Josiah's father, also posted bond. The will and bond are below: Montgomery Co., TN, Wills and Administration, Vol. F, Page 1: I Josiah Ogburn of the County of Montgomery and State of Tennessee being of sound mind and mindful of my mortality, do publish this my last will and testament in the manner and form following _____. I wish all my perishable property except what will be necessary for the support of my family to be sold on a ____ ____ created for the purpose of paying off my debts. And all the remainder of my property consisting of negroes and Land etc I give and bequeath to my wife Susan Ogburn during her natural life or widowhood but at her death or marriage to be equally divided amongst my children - John, Josiah, Sally Ann, William M., Daniel D., Edwin & Thomas M. Ogburn as they shall become of age. Lastly I appoint my Brother Thomas my Executor to this my will. This the 4th of October 1829. Signed in the presence of Josiah Ogburn Davin(?) Bayliss Robt. Recorded Octr Term 1829 Know all men by these presents that we Thomas Ogburn & Matthew Ogburn all of the County of Montgomery and State of Tennessee are held and firmly bound unto the Governor in and over the State of Tennessee or his successor in office in the penal(?) Sum of three thousand Dollars to be paid to the said Governor or his successor in office or their assigns. Which payment will and truly to be made and ___ we bind ourselves and heirs executing administrating and assigns jointly severally and firmly by these presents sealed with our seals and dated the 19th day of October 1829. The condition of the above obligation is such that whereas Thomas Ogburn is appointed Executor of the last will and testament of all and singularly the goods and Chattels rights and credits of Josiah Ogburn deceased and has qualified accordingly. ___ if the said Thomas Ogburn shall well and truly make or cause to be made a true and perfect inventory of all and singularly the goods and Chattels rights and credits of the deceased at the time of his death or which at any time hereafter may come unto the heirs or ____ of any other person or persons. And shall well and truly execute the said will according to the directions thereof and according to laws. And further to make or cause to be made a true and just account of his executorship according to the directions of the said will or within the ___ prescribed by law. And all the rest and residue of the goods and Chattels rights and credits which may be formed remaining in the hands of said Executor for accounting. And shall pay over and deliver to such person or persons respectively as the same shall be due according to the directions of the will thereof and agreeable to law. And shall well and truly execute or cause to be executed unto any County Court an account thereof. And in all things shall well and truly perform the duties enjoined on him as Executor according to the directions of said will of the said Josiah Ogburn deceased according to the laws of the County.
