7 April 1822 Will of Brnjamin Noel

In the name of God, Amen. I Benjamin Noel of the County of Mercer and State of Kentucky, being weak of body but of sound disposing mind and memory do make this my last Will and Testament as followeth (viz:) I recommend my soul to God and my body to the earth to be buried in a decent manner at the discretion of my executors in hopes of a glorious resurrection and eternal life throught the merits and mediation of our Lord Jesus Christ the only and all sufficient Savior, and as to the worldly possessions with which it has pleased God to bless me, it is my will that in the first place my funeral expenses and all the other debts I owe be paid and thereby empower my executors herein after named constituted and appointed or the survivors of them who shall qualify as such in a simple a manner as I could myself.

In the first place I give and bequeath unto my dear and well beloved wife Sarah, the tract of land whereon I now live together with that part whereon my son, Dudley, now lives with all the appurtanances thereunto belonging to my widow, together with one bed and furniture of her choice of all I have, one milk cow and calf, her choice, one horse or mare and her saddle beast to be her choice, one sow and four shoats, her choice, also two ewes and lambs, her choice, and one third part of all my household and kitchen furniture.

It is my will that the land above named, at the death of my wife, shall be sold and the money arising from the sale shall be equaly devided among my seven children. Dudley, Burrell, Joel, Horris, Willis and my daughters Lucy and Nancy. All and every part of property that may remain in the hands of my wife at her death, she may dispose of it as she may think fit to any one or none of my children above named.

Also my lands granted to me by patten lying in Christian Co. in the State of Kentucky, it is my will that the land be equally devided according to quality and quanity between my five sons above named.

All the remaining part of my property that is not above named shall be sold and appropreated to the payment of my debts together with all my bonds and accounts, and after paying my debts, whatever may remain I leave to my wife for her to dispose of it as she may seem fit and for the excuetors of this my last will I do by these present constitute and appoint John Allin, John B. Thompson and my wife Sarah Noel as excuetord of this my last will . As Witness my hand and seal this 7th day of April 1822.

Mercer Co. Kentucky, August Court. The foregoing last will and testament of Benjamin Noel, deceased, was produced into court and proven by the oaths of Henry Horine and Malcom Worley and David Worley thereon subscribing witnesses thereto and ordered to be recorded.
