On 7 March 1738 a petition was submitted by Anne Brooks in behalf of Benjamin, Thomas and Elizabeth Well, orphans of her late husband John Wells, dec'd. She states that Henry Wels [sic] used the said children without regard to a formal court order.

    On 24 June 1737 March court in a petition of Thomas and Benjamin Wells, sons of John, dec'd, not yet of age, chose Simeon [sic] Hirons as guardian. Also stated their discontent with the way Henry Wells handled the estate and since he might "gain something before we are of age, not thinking it advantageous to lie still." In an undated petition Hannah Brooks, widow of John Wells, stated that John Wells died leaving four small children, the eldest soon after bound out and the other three remained with her.       A distinctly Delaware family began with James Wells born about 1650 who acquired 29 Sept. 1677 land, SUN DYALLS in the Whorekill (now Sussex Co).(now the location of the City of Rehobeth, DE.).(Duke of York Records Page 176), The next year he was Justice of Court on the Whorekill with John Roades et al (Penn Archive Index 2, Vol. 5, p. 705) He married Mary daughter of John Roades, Surgeon and his wife Elizabeth (Will of Elizabeth), Children were Thomas, John and Kathryn. (See St. Peter's, Lewes, Del.)
      James Wells did not remain long at Sun Dyalls. . In 1680 he got a warrant for
      BRECKNECK on the west side of St. . Jones Creek, 900 acres in Kent Co., This was surveyed 24 Dec. by Eph Weomanther BK A/7 ( Book A Pg 32) 1680 and granted (600 acres) BK A/4 Also surveyed 1680 for him were Dundee adjoining Breckneck and Little Geneva. Book B pg 9 1680 (Scharf 2/436.). In 1681, James Wells and John Newall were sued by Henry Bowman of Sussex Co. over " horse race terms". (Manuscript Record of Court, of Deal, page 18. Penna Hist.. Soc..) in Feb. 1681/2 he and Alexander Humphrays were granted in LEASON 2000 acres and in 1683 his 1000 acres of this grant was surveyed (Warrant Liber A Folo 40 and 241). He was still acquiring land - 1681 HOWELLS - CHANCE and WHITWELLS DELIGHT, (Scharf, History of Delaware Pages 1139 and 1170) and Dec 31 1681 Howells Lot near Rising Sun (Colonial DE. records 1681 - 1773 Bruce A. Bendler, and Pg 6 KT Co. Rent Rolls 1681 - 1688) In 1683 with his wife Mary he sold Dundee to Daniel Joana mariner and John Nowell of Stockton on Tees, Durham, England "900 acres surveyed. 1680 now occupied by James Wells.... west side of Jones Creek" [DeedsKT B:21 5 Mar 1683] "On 15 Mar 1683 with wife Mary he sold DUNDEE to Daniel Jonans Toates mariner and John Nowell of Stockten on the Tees, Durham, England "900 acres surveyed 1680 now occupied by James Wells...west side of Jones Creek" (Kent Co. Land Records DeedKT B:21 Book B pg 21) At the same time James was given by Evan Davis of Cape May " who was indebted to James Welles " a mortgage to "Shrewsbury" [175 acres 1684]and "Bettys's Fortune" [DeedsKT B:72 30 July 1683] , and he must have moved to Little Creed Hundred for in 1684 Evan Davis deeded him Shrewsbury "now in tenure and occupation of James Wells"[DeedsKT B:72] and Betty's Fortune 500 acres on Duck Creek (Bk K/16 & 70)[Deed KT B1:97.98,99] This Land was sold by his children John, Thomas and Katharine Wells in 1701 [Deeds KT C:268 21 Oct 1701] . Also in 1683 he purchased 1000 acres Warrington on Jones Creek [DeedsKT B:82] and Hodgskins Choice on Murtherkill,(K1/16)[DeedsKT B:71], and 1200 acres unnamed from Joseph Moore.[Kent Land Records Abstract [DeedsKTB:72] Book B pg 72 5 May 1683 "Memorandum of a bargain of 12 Hundred acres of land between James Wells and Joseph Moore-that said more hath sold to the said Wells & doth promise to give according to law."] The above records are recorded in Kent Co., Penna. William Penn had united the area to Penna as the " three eastern counties" and thay continued so until the Revolution although each country exercised full powers of government. this has resulted in scattering of records: some are in New York where the Dutch claimed the region until 1664, when the English took possession: some records are in Pa. Archives and some in Delaware. A deed 1684 Kent Co., DE. of James Wells and Obadiah Juddins of Talbot Co. Md. for Geneva (part)[DeedsKT B1:112 & 113 1684] of Alex Humphreys "near James Wells house as " especially dower of Mary now wife of James Wells" and "provided the sd. James Wells be not compelled to travel farther than Philadelphia" [DeedsKT B:112 1 Jan 1685] James that year purchased more land on Murther Creek from Thomas Nodsin of Philadelphia. In 1684 James Wells of Kent served in the Assembly of Penna.(Duke of York Laws, pg 495) 17 Oct. 1684, James Wells was dead and adm. was granted to Marys Wells and Richard Mitchell (Wills and Adm.. 1683-95 page 24)[Ltrs.. of adm. on the est. of James Wells, dec'd were granted Mary Wells & Richard Mitchell, 17 Oct 1684(WellsHist ) and on that date the homeplace "where dwelled" [DeedsKT B:65/7 & K:81] was sold by Mary Mitchell, wife of Richard Mitchel of Talbot Co., MD. This was called Brecknock and same was recorded in Talbot Co. MD.(B65 & K81) Feb.15 1685/6 Mary Wells admxx and widow of James Welles and her issue John and Thomas , Planters of Kent Co. and Katherine, sold Betty's Fortune and Shresbury [DeedsKT B1:97,98,99 & DeedsKT O:268 ], "children corroborating" to Griffith Jones of Phila[DeedsKT B1:97,98,99] apparently in payment of a debt which she was "bowden for 39,200 pounds of Tabacco on demand" (B1/97). On 21 April 1685 Mary Wells, widow and Richard Mitchell of Talbot Co. MD. adm. of James Wells sold, in Kent Co., Pa. HOWELLS LOT [DeedsKT B1:65] near Dundee "laid out for James Wells."[DeedsKT B1:21]
      A thorough search of the plentiful land records available would likely find more such items. One in DeedsKT. S:136 for 3 March 1769 "nearly as hundred years laters covers Wells land.
      " A survey was made 6/26/1684 for Daniel Brown called FARMER ELSWORTH 900 acres N. side Main branch Murther Creek(Danaiel Brown had) had contracted to convey toJames Wells (1652-1684) who died before conveyance was maid,(made) and Daniel Brown conveyed to Mary (Roades)Wells (1653-1701) wife of James Welles and admx of his Will, and recorded this in the Rolls Office. Thomas Welles (1678-1732) eldest son of James Wells later conveyed (part of ) this tract to Mark Manlove, who sold it in 1735 to John Hunter, ( Spring Branch White Marah 311 acres including improvements made.) [DeedsKT E:296 &E:41]
      Whearas William R(h)oades (who)(brother of Mary Roades and wife of James Welles) married Mary (Hunter) Rhodes only daughter surviving of John Hunter, is now the present owner;(of Spring Branch White Marsh) William wishes to take conveyance from Rachael (Wells) Humphries (1705-1769) only surviving child of John Wells (1682-1721), son of JamesWells, and John's brother Thomas (1678-1732). Rachael may be intiled to 1/3 land of James Welles. She being heir to (her father) John Welles estate and John being heir to 1/3 of his father estate with his brother Thomas and sistor Katherin.[DeedsKT S1:202, DeedsKT S:136] .
      Whearas 30 March 1681 land WORCESTER was surveyed for Thomas Hodgskin, N side of Murther Creek 350 acres,(inc) Bishops Branch, and Thomas Hodgskin by deed 16 Sept.1684 to James Wells father of Thomas and John Welles (B,47) and Thomas Wells deed (in) 1721 to Andrew Caldwell and deed (in)1722 the said. WORCESTER to John Rhodes - now William son of John Rhodes ..... to unite the two tracts of FORMER ELSWORTH and take conveyance of both together from Rachel Humphreys."
      John Wells son of James Wells left will (A 53,231){WillsKT D1:46] naming children Rachel, James and John, but only Rachel wife of Alex Humphreys survived.[DeedsKT S:135] Abstract Land Records Kent Co Dl Vol S pg 135 for 3 March 1769 "lists Rachel WellsHumphreys only surviving child of John Wells."

      Item Eighth It is my will and I do order that if the suit now depend and others is Plaintiff and myself Defendant is not decided in my lifetime That if any my Executors or Heirs should Recover in the said Suits?? their and in such case it is my will and I do order that Five Hundred Dollars of the money so recovered shall be equally divided between Lydia Wells and Anne Wells and after all Expenses relative to said suit be paid got of the balance thru the Residue to be paid to my Daughter

      Text: " James Wells was appointed Justice of the peace at the Whorekill and Dependency, Delaware, by Governor Andros, Oct 8,1678. (Pa Arc Vol, 9 ser.2 p.705. James Wells was granted 600 acres of land Nov 17,1680 (Scharf's History of Delaware). James Welles was listed as a member of the first Assembly under the new charter of Penn, 1684 (Duke of York Laws, p. 495).
      James Welles bought land in Kent Co.Dl. According to a deed, Thomas Hodgkins , of Kent Co Provence of Pennsylvania, sold to James Wellls, of Kent Co.a tract of land called "Hodgkins Choyce," lying in the Murderkill, containing 400 acres on March 30, 1860 (Kent Co. deed book B,f,16)
      He apparentlly died in late 1683 or early 1684. On Jan 20 1864 Mary Wells,relict of James Wells,deceased, and Richard Mitchell, of Talbot Co. Planter (Md) both administrators of James Wells,signed an indenture with John Howell,of Stockton on Tease in Bishopric of Durham,Kingdom of England, mariner. James Wells had surveyed for him on Nov 25,1683 a parcel of land called "Howell's Lott" situated on a tract called "Dundee" formerly laid out for James Wells. containing 1, 000 acres. Wells,before his death,sold the tract to Howell for 10.000 ponds of Tobacco. However, Wells died without having surveyed the land. Witnesses to this transaction were John Brinkloo, William Southebo(?) and William Darnall.
      Mary Wells, on Dec 12 1685/6,paid Griffith Jones,Merchant of Phil, 19,200 pounds of tobacco.(Kent Co. Deed Book B,f,92) Three days later, Dec 15,1685/6 Mary Wells as adm. of her husband's estate, in return for 16,000 pounds of Tobacco sold to Griffith Jones a tract of land called "Betty's Fortune" situated on th west side of Delaware Bay and on one of the Three Duck Branches, 500 Acres, the transaction being finalized by a certificate from the Surveyer's Office(Kent Co. Deed book B,f,97)
      Two days later Dec 17,1685/6,Mary Wells for 3,300 pounds of tobacco,at public sale of creditors of James Welles,and secured by Griffith Jones, sold a tract of land called "Shrewsberry," located on west side of Delawae Bay and on north side of Little creek,adjacent to land of Richason called "Simpson's Chjoyce," of 175 acres, by certificate from the Surveyor's Office, Signed by Mary (x) Wells, and Robert Bradwell and witnessed by John Brinkle and William Rodnery(Kent Co Deed Book B,f,98)
      Mary Wells in 1686 continued to have a lot of work to do straightening out her husband's estate. On Apr 20, 1686 she signed an Article of agreement as Adm.and widow, of one part,with John Edmonton and William Dixon, of second part. She relinqished all estate (Personal and Real) except that which she kept for her own use. The chief part she kept as 400 acres on south sidde of Mispillion Creek, and such moveables as goods, Hogs,and horses that wre mentioned in an inventory and to cause no damages, trouble,charges or cost whatsoever, They bound themselves in sum of F100 Stearling Money of Englad. Witnessed werr John Roades and William Rodney. (Kent Co. Deed Book B2nd, f, 75)
      At a session of Commissioners,14th 5th(May) Month, 1708 ,Evan Davies, was granted 500 acres of land in Kent Co.,Del., called "Betty's Fortune" on one of the three Duck branches, first granted by order of the court in 1679 and confirmed by the transaction of the 26th,1(first Jan??)month and 1684. At Dover, Evan Davies, for 1 bushel of wheat, dated 20,6th(June) month 1684, granted the 500 acres tract with another 175 acre property being a plantation called "Shrewsberry, "located on Little Creek, to James Wells. After James Wells died his two sons, Jahn and James,and daughter Catherine being his heirs (in addition to his wife) by their "jeyat" (sic"joint) deed dated 21 8ber(Aug ?) 1701 granting the two pieces of land to Griffis Jones of Philadelphia. (Pa.Arc 2d Ser.,Vol,19 p. 494)
      On Oct 1 1701, John and Thomas Wells and Catherine Wells, "spinster," of Kent Co., Province of Pennsylvania as children of th late James Wells, made a Quit Claim Deed to Griffith Jones for three treacts "Betty's Fortune","Shrewsberrry" and "Simpson's Choyce" Mary Wells and Richard Mitchell as adm. had sold these tracts to Griffith Jones to pay debts on The estate.
      The next document in the settling of James Wells' estate occurred in 1712. Thomas Wellls, eldest son of James Wells, executed a deed with Mark Maline, joiner, of Kent Co., for f50 money, land called "Ellsworth" on west side of Delaware Bay and north side of Mother Creekk,containing 900 acres. Executed on June 20,1684,but not acknowledge in open court til May 15, 1712. Samuell Berry and Hugh Durborow(?) were witesses (Kent Co Deed Book E,p. 296)
      Seventeen years later, in 1729 Thomas Wells of Murderkill, Kent Co., and his wife Anne, signed a deed with William Clark of same hundred for 20 acres. For considerations of natural live and affection he heareth unto Willian Clark and Mary Clark, his wife, daughter of said Thomas, and for other good causes,did grant to William and Mary Clark, the 20 acres leading from bridge to the town of Dover. signed by Thomas (x) Wells ad Ann Wells on Feb 9, 1729 and acknowledged in court Feb 12,1729 (Kent Co.,Deed Book 1 p.223)
      Similarly,Thomas Wells,Sr.,of Murderkill Hundred, "for natural love and affection he bears towards his son,Thomas Wells Jr. gives 100 acre tract of land called "Wells Purchase." The deed was dated Feb 5, 1729 and witnessed by William McNeal and John Kees. (Kent Co Deed Book I, p.. 224) Henry Wells, and wife Sara, of Kent Co., Del. sell to John Taylor, 56 acres part of a grant of 356 acres. The warrant was dated May 12, 1741 in Phila., South side of Dover River in Mrderkill Hundred, Kent Co., (Kent Co. Deed Book M, f. 149 Nov 10 1741)
      James Wells of Little Creek Hundred, eldist son of John Wells, of Kent Co.,Dl. (yoeman) late of same place, dec'd, to William Hoey, of same place,weaver, John Wells, by his will excuted in the Register's Office for Co.afsd. bequeathed all his lands in his right to his two sons, James Wells, partie to these presents, and John his other son, which yet remains undivided between the two sons. This tract called
      "Cippanorton", bought by John Wells in is lifetime from Thomas Nixon and Mary wife, adm. of Estate of Benjamin Brady, dec'd. John Wells sold part in his lifetime to Humphrey Barret.       Ann Wells, widow and exec['s of Thomas Wells,Sr., late of Kent Co. on the Delaware, yeoman, to Thomas Parke, of Kent Co. Thomas Wells, whereas, by his last will and testament,dated Jan 24 1731, did provide for his wife Ann Wells as his exec to make sale.       On 13 Feb 1737 Philip Fields stated George Medcalf had a man child bound to him named James Wells being the son of your petitioner's wife. Susannah Fields made her mark. On 24 June 1737 James Brooks in his petition to the court stated that he had married the extx. of John Wells, dec'd. On 7 March 1738 a petition was submitted by Anne Brooks in behalf of Benjamin, Thomas and Elizabeth Well, orphans of her late husband John Wells, dec'd. She states that Henry Wels [sic] used the said children without regard to a formal court order. On June 18 1745 in a petition from Henry Wells he stated he was the uncle of James Wells who is an orphan and destitute; James Wells was bound to Philip Fields, but Henry Wells now requests that he take care of James.
      In March court in a petition of Thomas and Benjamin Wells, sons of John, dec'd, not yet of age, chose Simeon [sic] Hirons as guardian. Also stated their discontent with the way Henry Wells handled the estate and since he might "gain something before we are of age, not thinking it advantageous to lie still." In an undated petition Hannah Brooks, widow of John Wells, stated that John Wells died leaving four small children, the eldest soon after bound out and the other three remained with her.       On 7 Feb 1750 Benjamin Wells, Ann Wells and Thomas Wells all of Kent Co. for 11 pounds sold to Benjaman [sic] Brown of same place, bricklayer, the remainder of a tract of land formorly [sic] belonging to John Wells being part of a larger tract called Leason which land was left by Thomas Wells to his afsd. son John Wells at land belonging to Andrew Hamilton {sic], to land of Thomas parke sold by John Wells and Ann Wells...15 3/4 a.       The Thomas Wells who died in Lincoln Co., TN (correct date of death is May 30, 1858)is not the Thomas Wells that married Mary Ann Hoskins. Thomas Wells and Mary Ann Hoskins were married November 26, 1809 in Nelson Co. KY, not TN as stated by Don Harp.(There is no Nelson Co., TN). This Thomas was still in Nelson Co., KY in 1820 and 1830. He had moved to Clark Co., MO by 1840. In 1850, he and Mary are shown in the Clark Co., MO census living with their son, Alva H. Wells, age 37 born in KY. Thomas is 72 and Mary is 66. Thomas Wells died in MO on February 14, 1855. Mary Ann Hoskins Wells died November 1, 1873.

      The Thomas Wells who died in Lincoln County, TN lived in Clark Co., IN., not Missouri. In 1830 he was taxed on land in Lincoln Co., TN. His son William Benjamin Wells was born in Clark Co. IN in 1817. Son, Francis Wells was born December 26, 1819 in Clark Co., IN. (Documented by CSA service records). Census records document his presence in Lincoln Co., TN in 1840 and 1850. This Thomas Wells is well documented by census records, family bible records and probate records. It is unlikely that the same Thomas Wells could have been in two places at once.

      On 13 Feb 1737 Philip Fields stated
      George Medcalf had a man child bound to him named
      James Wells being the son of your petitioner's wife. Annah /Hanna (Brooks) Green
      Susannah Fields made her mark. On 24 June 1737
      Henry Wells he stated he was the uncle of James Wells son of John 1732 who is an orphan and destitute; James Wells was bound to Philip Fields, but Henry Wells now requests that he take care of James.
      James Brooks in his petition to the court stated that he had married the extx. of John Wells, dec'd. Annah/Hannah Green
      On 7 March 1738 a petition was submitted by Anne Brooks in behalf of Benjamin, Thomas and Elizabeth Wells, orphans of her late husband John Wells, dec'd. She states that Henry Wels [sic] used the said children without regard to a formal court order. On June 18 1745 in a petition from
      Henry Wells he stated he was the uncle of James Wells son of John d 1733 who is an orphan and destitute; James Wells was bound to Philip Fields, but Henry Wells now requests that he take care of James.
      In March court in a petition of Thomas and Benjamin Wells, sons of John, dec'd, not yet of age, chose Simeon [sic] Hirons as guardian. Also stated their discontent with the way Henry Wells handled the estate and since he might "gain something before we are of age, not thinking it advantageous to lie still."
      In an undated petition Hannah Brooks, widow of John Wells, stated that John Wells died leaving four small children, the eldest soon after bound out and the other three remained with her. (KEORCF Wells, John, dec'd)
      On 7 Feb 1750 Benjamin Wells, Ann Wells and Thomas Wells all of Kent Co. for 11 pounds sold to Benjaman [sic] Brown of same place, bricklayer, the remainder of a tract of land formorly [sic] belonging to John Wells being part of a larger tract called Leason which land was left by Thomas Wells to his afsd. son John Wells at land belonging to Andrew Hamilton {sic], to land of Thomas parke sold by John Wells and Ann Wells...15 3/4 a.
