    $1,475,000 SETTLES $22,250,000 SUITS

(New York Times, 26 March 1936, page 33.)

Supreme Court Justice Alfred Frankenthaler approved yesterday a petition by Louis H. Fink, State Superintendant of Insurance, for permission to compromise for $1,475,000 two suits against former directors of the New York Title Company, the Bank of Manhattan Company, and the National Mortgage Company.
    The suits were for $22,250,000.

The New York Title and Mortgage suit was brought to recover damages because of alleged violations by the Directors of the duties of their office and by reason of various transactions between the Title Company and the Bank of Manhattan Company which controlled it.

The payment of $1,250,000 in that case is to be made by the following:

Harry A. Kahler, J. Stewart Baker, Richard G. Babbage, William F. Clare, Lewis L. Clarke, Walter V. Cranford, James R. Deering, Lawrence B. Elliman,
Frederic J. Fuller, W. Burke Harmon, W. Averill Harriman, Henry A. Ingraham, Stanley P. Jadwin, Frederick I. T. Kelsey, Fred C. Lemmerman,
    George T. Mortimer, Morgan J. O'Brien, J. O'Brien, Jr., James A. O'Gorman, Park A. Rowley, Matthew S. Sloan, James P. Warburg, H. Pushae Williams,
and the Bank of Manhattan Company, and the estates of Frederick W. Allen, Charles A. Angell, Albert B. Boardman, Hugo Hirsh, William Obermayer,
Paul M. Warburg, and George Zabriskie.

This would have been about $40,000 per defendant.

(By this time William Francis Clare, Sr. had died).

    WILLIAM F. CLARE

William F. Clare, a life member of the Society died on 11 December 1935 at his residence 1165 Fifth Avenue, New York City. A native New Yorker he was born in the year 1866.

Graduating from New York University Mr. Clare was admitted to the Bar and practiced his profession for forty-eight years. Early in his career he formed a partnership with the late James F. Campbell. Later he practiced alone, specializing in realty and estate law.

Even as a young man Mr. Clare actively interested himself in charitable and civic affairs. For many years he was with the Catholic Club, serving on its Board of Managers. He was a trustee of the Catholic Institute for the Blind and gave liberally of his time and talent to its organization and administration.

For a few years prior to his death Mr. Clare suffered from ill health. This to his regret prevented his active participation in the several benevolent institutions with which he was affiliated. His interest however was maintained until the end.

He was kindly and affable. Able and highly considered in his profession he was greatly respected by his associates. He won and held the esteem of all with whom he came in contact. Charitable in thought and word his willingness to aid any deserving cause was an outstanding characteristic. His friends testify to his devotion, to his ideals, and his memory will be cherished by the members of the Society.

Mr. Clare was a member of the Manhattan Club, the New York Athletic Club, the Catholic Club, the New York Law Institute, the State, County, and City Bar Association.

Surviving are his wife Mary R. Clare, and two sons: N. Holmes and William F. Clare, Jr.; three sisters, Mary E., Lillian Clare, and Mrs. Joseph Mulligan, and a brother James L. Clare, life member of the Society.

We mourn his passing, and to his wife and family we extend our deepest sympathy.
