29 May 1848 Declaration Of Intention of Mathias Eberly York County SS: Be it remembered that on the 29th day of May A.D. eighteen hunundred and forty-eight, personally appeared before me the Prothonotary of the Court of Common Pleas of said County, Mathis Eberly, an alien, who being sworn according to law, doth declare and say, that it is his bonafide intention to become a citizen of the United States of America and to renounce and abjure absolutely and entirely all allegiance and fidelity to every foreign Prince, Potentate, State or Sovereignty whatsoever and particularly to Leopold Grand Duke of Baden his heirs and successors forever. PETITION OF MATTHIAS EBERLY for NATURALIZATION FILED JANUARY 5, 1852 TO THE HONORABLE THE JUDGES OF THE COURT OF COMMON PLEAS OF THE COUNTY OF YORK: The Petition of Matthias Eberly an alien and native of Baden, Respectfully Showeth, that he has made a declaration of his bona fide intention to become a Citizen of the United States of America, agreeably to the laws of Congress in such case made and provided-- that he has resided within the said united States five years and upwards next preceding this time, without having been during that time out of the Territory of the United States, and one year last past in the State of Pennsylvania: Wherefore hr prays your Honours that he may be admitted to the rights of Citizenship, and as in duty bound will ever pray. Matthias Eberly(his signature) George Wildin, a Citizen of the United States appearing in open Court, who being duly sworn doth depose and say that the Petitioner above named, has resided within the United States of America five years and upward,next prceding this time, without having been during that time out of the Territory of the United States, and one year last past in the State of Pennsylvania, and has, to the best of his knowledge and belief, during all that time behaved himself as a man of good moral character: attached to the principles of the Constitution of the United States of America, and is well disposed to thr good order or happiness of the same. Matthias Eberly appearing in open Court, who being duly sworn doth depose and say that he will support the Constitution of the United States of America, and that of the Commonwealth of Pennsylvania, and that he does absolutely and entirely renounce and abjure all allegiance and fidelity to any foreign Prince, Potentate, State or Sovereignty whatsoever, and particularly to Leopold Grand Duke Of Baden, his heirs and successors forever Sworn and subscribed in open Court of Common Pleas of York County, this 5 day of January 1852 Matthias Eberly(his signature) E. Wherupon the Court order and direct that the said Matthias Eberly,be,and is hereby admitted a Citizen of the United States of America, agreeably to the prayer of his petition; and the Prothonotary was ordered to record the name, which is accordingly done.
LAST WILL &TESTAMENT OF MATHIAS EBERLY In the name of God Amen. I Mathias Eberly of York Township in the County of York and State of Pennsylvania being in health of body and of sound disposing mind,memory and understanding,do make and publish this my last will and testament in manner and form following to wit; First: It is my will and I do order, that all my just debts and funeral expenses be duly paid and satisfied,as soon as conveniently can be after my decease,I give and bequeath unto my beloved wife Catherine Eberly all my real and personal estate of what kind or nature whatsoever the same may be in th County of York or elsewhere for and during her natural life; and from,and immediately after her decease, I give and devise the same unto my several children equally share and share alike and to their heirs and assigns forever,to be equally divided among them, And lastly, I nominate constitute and appoint my said wife Catherine sole executrix of this my last will and testament,hereby revoking and making void all and every other will or wills at any time hereafter by me made,and do declare this to be my last will and testament,For witness whereof I the said Mathias Eberly, have hereunto set my hand and seal this 3rd day of April A.D.1865 Mathias Eberly (seal) Signed sealed declared and published by the above named Mathias Eberly as and for his last will and testament in the presence of us,who at his request, and in his presence,have subscribed our names as witnesses thereto John S.Kerch Charles Shirey YORK COUNTY SS; Before me,Jacob Stickel Register of the Probate of Wills and of Grantnig Letters of Administration in and for the County of York, personally appeared John S.Kerch & Charles Shirey the subscribing witnesses to the foregoing will, who,upon being duly qualified according to law,do depose and say,that they were personally present and saw and heard Mathias Eberly late of York Township decd the testator sign ,seal publish,pronounce and declare the -------- and foregoing instrument of writing as and for his last will and testament, and the time of his so doing he the testator was of sound and disposing mind,memory and understanding to the best of their knowledge and belief, and that they witnessed the same at the request of the testator and in the presence of each other at the same time.
