BACKGROUND INFORMATION:
Benjamin lived primarily in the Holmes Creek area of DeKalb Co,TN which was formed l837 from Cannon, Jackson,Smith,White & Warren Cos. Cannon Co, TN was only formed in l836, and the part that later became DeKalb was primarily in Warren before that date. The Caney Fork River flows through DeKalb Co, and Holmes Creek where Benjamin resided flows into the Caney Fork, NW of Smithville. When DeKalb was established the Smith & Warren Co,TN line cut across Holmes Creek. Today Holmes Creek lies under Center Hill Lake.

Birth Date Determination
--In 1820 Census he is listed 26-45 which makes him born between 1775 & 1794. --In 1830 Census he is 40-50 which makes him born 1780-1790
--By 1808 he is still not listed on fathers tax list as 16 or over & this would make him born after 1792 (This can be explained as men were not likely to go to Court House and report that their son had turned 16, and probably would not report unless tax collector asked.)(His father, Joseph had married Barbaray Parkeson June 15, 1790)

Therefore I SUSPECT that Benjamin was born late probably in 1791.

The land was surveyed on 25 Apr 1814 with survey chain carriers Joseph Inabnit and Benjamin Inabnit. The survey was taken out (of office) by Joseph Inabnit on 11 Mar 1815. The land was granted on 7 Aug 1815 by Grant number 7586.

Benjamin Atnip Will State of Tennessee DeKalb County September the first day in the Year of our Lord one thousand eight hundred and thirty eight.

In the name of God amen whereas I Benjamin Atnip of the county and state above named, and weak in body but sound in mind and now particularly that I myself am not long for this world and feeling anxious about the well fare of my beloved children hereby dispose of my estate in
manner and form following that is to say.

Item first that as much of my personal property be sold as will pay all my just debts if other arrangements cannot be made to pay them.

Item 2,It is my will and desire that my land with my plantation and buildings be for the use of my wife to raise my children on during her natural life of widowhood provided nevertheless. If my wife Gemima should marry again the and in case it is my will and desire that my wife Gemima Atnip have a childs part of my land and other property that may be on the premises.

Item 3 It is my will and desire that the following named children (to wit) Stephen Jacob John and Enoch Boys--Anny Elizabeth Polly Ellinor Gemima and Sindy girls being children of my present (first marked out and present written above) wife Gemima Atnip have as follows that is to say each one of the boys to have a horse beast Equal to one given to each one of my older sons (to wit) Joseph Alexander and Benjamin also it is my will and desire the above named Stephen Jacob John and Enoch my son Enoch have Cow brute equal in value to one given to Joseph and also given to Alexander.

Item 4 It is my will and desire that my Daughters (to wit) Anny Elizabeth Polly Ellinor Gemima dn Sindy have property or money to make them equal with the above named boys.

Item 5 It is my will and desire that in case of the death or marriage of my wife Gemima Atnip that after giving to my children as herein before denoted all the Balance left (to wit) land and all property to be sold and equally divided among the following named sons and daughters Joseph Atnip Alexander Benjamin Stephen Jacob John and Enoch my sons and Anny Elizabeth Polly Ellinor Gemima and Sindy daughters and as each do ordain this my last will and testament hereby revoking all former wills. If any of them should be and do aforesaid will into effect. Witness my hand and seal this day and year first above written signed sealed and delivered in the presents of the subscribing witnesses.

Benjamin signed with his mark an "X". The witnesses to the will were Thomas Durham and John Wilmouth.

INTERESTING OBSERVATIONS REGARDING WILL OF BENJAMIN
(From Research of Mitch Jones)

Benjamin's will names all of his living children, and it appears to name them per male and female in the order of their birth. The will also indicates that Jemima was his second wife, and that Joseph, Alexander, and Benjamin were children of his first wife.

Another interesting item about Benjamin's will is the part where he leaves his farm to his wife Gemima as long as she remains unwed, but if she marries again she is to get only a child's part. Benjamin was really protecting his wife. During that time period, if a woman married, all her property became her husband's. He could do with the property as he pleased

Benjamin and John Atnip were granted 200 acres of land on Pine Creek in DeKalb County. This grant is very important as it helps us establish family relationship in the Atnip family. This land was sold on 10 Feb 1845 to Joseph Atnip. The deed was from John Atnip of Johnson Co., IL, to Joseph Atnip of DeKalb Co., TN. John states that the 200 acres was entered jointly between Benjamin Atnip my brother and myself. The deed was witnessed in Johnson County by Abraham and John McGinnis.

Beginning on a stake it being the north east corner of a 150 acre survey of land in the name of Durham Perkins and Burgefs now belonging to Thomas Durham the same that includes the mouth of pine creek. The west on a survey made in the name of John Hustt 300 poles before we came to vacant land to where this survey begins to include land. Continued 285 poles to a stake. The Corner of a 600 acre survey belonging to William H. Allen and in the north the boundary line of a 1242 acre survey owned by Thomas Durham then north 105 poles to a Black oak corner. Corner of said Joseph Evans 175 acres survey. Thence east 280 poles running with Evan's line to a stake ; then south 105 poles to Husts line. Including 200 acres south tho here litaments and appurtenances to have and to hold the said track or parcel of land with it 92s appurtenances to the said Benjamin & John Atnip and their heirs forever. State of Tennessee DeKalb County August Term 1840 a paper purporting to be the last will and testament of Benjamin Atnips decd was presented in open Court for probab and was duly proven in open court by the oaths of Thomas Durham and John Wilmouth subscribing witness to the same who first sworn dispose and say that they were acquainted with Benjamin Atnip the testator and that they signed the said will in his presents by his request and on motion ordered that said will be recorded Witness T M Wade Clerk of our said county Court at office 4th day of August 1840. TM Wade Clerk DeKalb Co., TN Will BK A pgs 16/17.( I don't know if probation date was 1840. Last number appears to be same as last number of page number which is 7, but Benjamin Jr sold his share in 1844 so Sr dead by 1844. The last number of year is somewhat similar to 4. It is possible Sr dead by Aug 1844, and Jr sells land in Oct. 1844.)

My note: The last 2 children above (Jemima age 3 and John age 2) are children of Jacob and (1)  ____Williams. Evidently, Jacob's mother Jemima (widow of Benjamin) was keeping the 2 children for him, and living next door to him. He had to make a living and someone had to care for the children. Jacob married Susannah T. Watts March 27, 1851, so he had not remarried when the census was taken.  We now know that child Jemima (Mary Jemima) died young, and that John was John William and he grew up had a family.

Atnip; Jemima Atnip Junior; Enoch Atnip; and Linder Atnip. Begin Robt Megasons old corner & Benjamin Atnips old corner also S40E8P N line of 100A survey belonging said heirs E with line 20P to begin corner of said 100A survey 150P in Henry Frazers line E with Frazers line 82P in Easthams line N with Eastham's line 198P in said line W102P. Entry calls for 300A.

(Note: Benjamin Atnip, Jr. is not named in the land grant, and there is only one reason for him to not be named. He had died by 1850 with no surviving heirs. As Benjamin Atniss he is listed on the 1840 Census of Jackson Co., TN in District 13 among the entries of Prettyman Jones.
