To the Court: The Petition of J. S. Cox as Adm. of the Estate of Immer Bean, Deceased, respectfully Sheweth, That he was appointed administrator of said intestates Estate by the Clerk of Superior Court of Randolph on the 13th day of Dec. 1887 and at once entered upon the administration of said Estate. Your Petitioner further Showeth
That from the best information and knowledge which he has been able to obtain the outstanding debts of said Estate amount to Two hundredand Twenty dollars. That the value of the personal Estate is about Ten Dollars.
That at the time of his death the said intestate was seized in fee simple of the following lands in Randolph County to wit.
A tract of land on Little River adjoining the lands of John Lucas, Madison Cox, Daniel McLeod, David Sikes and others containing 303 acres more or less, of the value of about one dollar per acre and that said lands descended to his children, to wit.
1. The defendant John Bean resides in Montgomery County (NC) 2. The heirs of Allen H. Bean deceased to wit: J. P. Bean residing in Montgomery County and William H. Bean residing in the State of Texas. 3. Sallie Cornelison wife of Allen Cornelison who reside in Randolph County. 4. The heirs of Mahala Boon, deceased, to wit: Messa Boon, Roby Boon, ______Boon, infants residing at Willard Boons in Randolph. 5. Heirs of Benjamin Bean, deceased, to wit. William H. Bean, Mary Cole residing in Randolph. 6. Mary Davidson living at randleman, NC. 7. Elizabeth Lucas, wife of John Lucas residing in Randolph County, Pisgah P. O. 8. William Bean
Your Petitioner further showeth that a sale of said lands is necessary to enable him to pay the debts of his intestate and the charges of his administration.
To the end therefore that said land may be sold by your Petitioner under a decree of this court on such terms as the court may direct and that the proceeds of sale may constitute assets in his hands for the payment of said debts and charges. Your Petitioner prays that a summons be issued to and served upon the defendants and that publication of summons be made for the non resident defendant requiring them to appear and answer etc. and that a proper Guardian ad litum be appointed for the infant defendants to defend this action in their behalf. Immer and Sarah Bean are buried at either Suggs Creek Primitive Baptist Church, or in family cemetery owned by Ken McLeod on the west side of Highway 134, just south of the Randolph County line.
