    I have been doing research on The Peytons since 1980 and Capt. James Peyton was
    not the James Peyton Who is listed as recieving a 100 acre land patent in Va.
    Capt. Peyton never received a land grant for being in the Continental line. He
    was already in the Augusta, Fincastle, Boutetourt, Kentucky, Then Lincoln county
    area during the revolution. He was a Captain in the Kentucky County Militia and
    then also in the Lincoln County Militia. He had many thousands of acres of patents
    which were all Treasury Warrants and his one preemtion warrant of four hundred acres for raising a crop in 1778 in Kentucky County Virginia. This warrant was issued to him on Slate Creek which is now in Bath County Ky. near Boonsborough. Thre were no Rev. War Land grants issued in the area he was in. They were all south of the Green River and in the Va. Military District which was in Ohio. The James Peyton That was a private moved into Fayette County on Hingston Creek later on. Thanks Harold W.     Earliest date shown is 1785 for James Payton and family. The sons of James are also listed as owners; Daniel, Elias/Eias, Elijah, Elisha, Samuel and Leigh. ( No mention of Samuel and Leigh in the Will, possible middle names)

    Will of James Peyton, Nelson Co., KY, Written 27 March 1789. Proved 9 June 1789

    In the name of God, Amen. I, James Peyton, being weak in body but of sound memory and taking into consideration the frailties of man, do make this, my last will and testament.

    First, I will that my just Debts and funeral expenses be paid.

    Secondly, I give and bequeath to my well beloved wife Susannah the plantation I now live on with all the moveable effects and a Negro named Will her life Time Exclusive of that part whereon my son Elisha Peyton now lives on.

    Thirdly, I will that all my land that I own on the waters of Green River be equally divided between my sons and daughters, sons, Elijah, Elisha, Elias, Daniel, and Evan Peyton. Daughters Ruth, Anne, Sucky, Jimimah and Fanny Peyton excep my daughter Anne’s part of said land which is to be Equally Divided between her and her eldest son Peyton Threlkeld.

    Likewise will that my son Elijah shall make choice for my son Evan his part of said land to join upon an outside and in a regular form and at the said the Evans death if not sold by him and no lawful heir then to return to the said Elijah, and if he dying without a lawful heir then to be Equally divided between Elias and Dan’l Peyton and Sucky Jimimah and Fanny Peyton.

    Likewise I give and bequeath to my son Evan a negro boy named Will after the decease of my wife Susannah till his death. If he dies without a lawful heir he is to Return to my son Elijah and if he dies without a lawful heir then he is to be valued or sold and Equally divided between Elias and Dan’l Peyton and Sucky Jimimah and Fanny Peyton.

    I give and bequeath to my son Elisha Peyton one hundred acres of land where he now lives, a part of the Tract of land whereon I now live.

    Likewise, I give and bequeath to my sons Elias and Dan’l Peyton the remainder of the said Tract of land after the death of my wife Susannah with all the moveable effects excepting a cow and calf and a feather bed to each of my three daughters
    Sucky Jemimah and Fanny and to my son Evan and lastly I will that my beloved wife Susannah be my Executrix and my trusty friends James Rogers and Thomas Polke be my executors of this, my last will and Testiment, the word son in the thirteeth line and the word devided between in Eighteenth line was inter lined before the signing and sealing of

    Signed, sealed Ratified and Confirmed in the of us this 27th day of March 1789
