    This case was heard in TN in the September Term, 1852.

    The TN Supreme Court, in the case of Stuart vs. Clark's lessee, reversed a ruling by Judge Luckey of Washington County who had earlier ruled for Stuart. The key argument was whether the Nolachucky River was a navigable river or not.

    NOTE1: I do NOT belive that this Cornelius O'Neal who was in Washington Co, NC (now TN) and Greene Co, TN is the same Cornelius O'Neal who married Polly Lookey (Lokey).

    Many undocumented trees at the WorldConnect Project have these two individuals identified as the same person. I don't belive that to be the case.

    I think it is more likely that this Cornelius is the same person as
    Cornelius "Anson County" O'Neal that I have listed at:

    This Cornelius O'Neal appears to live near and probably is a relative of Robert O'Neal who obtained his land in TN via land grants from the state of North Carolina

    This Cornelius O'Neal may have been the father of a group of son's who used the surname NEAL. Cornelius was "of old Virginia and North Carolina" and migrated to Greene Co, TN at some point, owning land near the Nolechucky River.
    (per an Eldon, Missouri newspaper account)

    NOTE: Some researchers have concluded that the father of Capt. Peter NEAL and his brothers who were in southern MO and AR before coming to OR was a Benjamin NEAL, who was from Loudon Co, VA and was married in Greene Co, TN.

    The Eldon, MO newspaper article that I cite as a source in my Cornelius O'NEAL entry in this file indicates that these NEAL brothers were sons of Cornelius O'NEAL of the Nolachucky River area in TN.

    These accounts are obviously in conflict, and I do not have convincing proof of one version of the story over the other at this point, so I have left both Cornelius O'NEAL and Benjamin NEAL as parents until further evidence is uncovered to determine which is the correct lineage.

    As I find more info on this particular Cornelius, I am beginning to doubt the Eldon, MO newspaper record, however, as the Cornelius O'Neal in Greene Co, TN would appear to be very old to be the father of the NEAL brothers who were in AR and MO before going to OR.

    . . . .Other relatives crossing the plains in 1852 were not so fortunate. One
    group, headed by Captain Peter Neal, who married Mahala Bilyeu, in the train
    commanded by Captain Cornelius Gilliam, lost many members. Except for one
    child the entire family of Valentine Neal, a brother to Capt. Peter, died on
    the trail.

    Hubbard Bilyeu, a brother of William who married Diannah Coker, was the
    father of at least five daughters.

    Four of them married Neal brothers, but the fifth Neal brother balked, saying one more would be too many. The Neal boys were children of old Cornelius O'neal of North Carolina and Virginia, later situated by the Nolechucky in Green County, Tenn. Before coming to Missouri. The surviving child of Valentine Neal's family was taken in by
    brother, Calvin, who married Alcy Bilyeu. . . .
